HomeMy WebLinkAbout1988-336-06.20.1988 RESOLUTION NO. 1988-336 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION PERMANENT AND TEMPORARY EASEMENT CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEEDS AND EASEMENTS. WHEREAS, the City of Waterloo, Iowa, has had all the parcels described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcels is necessary to carry out the FY 1988 Northeast Area Sanitary Sewer Extension, Contract No. 344, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcels hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the properties from the owners thereof, and the deeds for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sales from City funds. The subject parcels are: Willard R. Frost and Norma J. Frost, Owners--Permanent Easement All that part of the Southeast 1/4 of the Northwest 1/4 , of Section 21 , Township 89 North, Range 12 West of the Fifth Principal Meridian, Waterloo, Black Hawk County, Iowa, lying within the following described boundary: Beginning at a point on the Northwesterly right-of-way line of the Chicago and North Western Transportation Company Railroad which point is 1,018 . 64 feet Northeasterly from the point of intersection of said Northwesterly railroad right-of-way line with the West line of the Southeast 1/4 of the Northwest 1/4 of said Section 21; thence North 00°22 ' 33" West a distance of 31. 93 feet; thence North 69°35 ' 53" East parallel with said Northwesterly railroad right-of-way line a distance of 15 . 0 feet; thence South 20°24 ' 07" East a distance of 30. 00 feet; thence South 69°35 ' 53" West along said Northwesterly railroad right-of-way line a distance of 25 . 93 feet to the point of beginning.
