RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND
NOTICE TO BE GIVEN ON THE VACATION, SALE AND CONVEYANCE
OF A PORTION OF FAIRBANKS AVENUE AS AUGUST 8, 1988 , AT
7: 00 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA
AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF
HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 7: 00 p.m. on the 8th day of August, 1988 , for the purpose
of considering and acting upon a proposal to vacate a portion of
Fairbanks Avenue owned by the City of Waterloo, Iowa, and legally
described as follows:
Fairbanks Drive commencing at the westerly ROW line of
Forrester Ave, thence westerly to CRI & P Railroad thence
northwesterly to easterly line Lot 13 Auditor Whitney' s Road
Plat Castle Hill, in the City of Waterloo, Black Hawk County,
Iowa.
and sell and convey a portion of Fairbanks Avenue owned by the
City of Waterloo, Iowa, to Northland Products Co. , Inc. , and
legally described as follows:
Fairbanks Drive commencing at the pt of intersection of
northerly line of Fairbanks Drive and the westerly line of
Forrester Avenue thence westerly along the northerly line of
Fairbanks Drive 351 . 4 ft M/L to a pt 20 feet easterly of
Railroad ROW thence northwesterly along the northerly line of
Fairbanks Drive 150. 7 ft M/L thence southwesterly a distance
of 20 ft M/L to southerly ROW line of Fairbanks Drive thence
southeasterly along said ROW 160 ft M/L thence easterly along
ROW to westerly line of Forrester Avenue thence north 20 ft
M/L to pt of beginning, all in the City of Waterloo, Black
Hawk County, Iowa;
and sell and convey City owned property to Northland Products Co. ,
Inc. , and legally described as follows:
That part of Lot One ( 1 ) in Sherwood Park, a subdivision in
Sections Sixteen ( 16 ) and Twenty-one ( 21) , Township
Eighty-nine North (T89N) , Range Thirteen West (R13W) , in the
City of Waterloo, Black Hawk County, Iowa, described as
follows:
Beginning at the Southwest corner of said Lot One ( 1) ; thence
Northeasterly along the Northwesterly line of Lot One ( 1) ,
Twenty-five ( 25 ) feet; thence Southeasterly Twenty-six and
Forty-Five Hundredths ( 26 . 45) feet to a point on the South
line of Lot One ( 1) ; thence Westerly along the South line of
Lot One ( 1) Thirty ( 30 ) feet to the point of beginning,
for $31 . 30 , plus costs;
and sell and convey City owned property to Northland Products Co. ,
Inc. , and legally described as follows:
Those parts of Lots Two ( 2) and Three ( 3 ) in Sherwood Park, a
subdivision in Sections Sixteen ( 16 ) and Twenty-one ( 21) ,
Township Eighty-nine North (T89N) , Range Thirteen West
(R13W) , in the City of Waterloo, Black Hawk County, Iowa,
described as follows:

Section 2 . That the City Clerk is hereby directed to publish
notice of the time and place of said hearing in the Waterloo
Courier.
