Co EH c RESPONSIBILITY TO PROVIDE A SANITARY DISPOSAL PROJECT.
WHEREAS, the City of Waterloo (hereinafter City) , is a member
government of the Black Hawk County Solid Waste Management
Commission, (hereinafter Commission) , an Intergovernmental Agency
formed pursuant to the provisions of Chapter 28E of the Iowa Code,
for the purpose of meeting the responsibilities imposed by the
Legislature to provide a solid waste disposal project as defined
in Chapter 455B of the Iowa Code, and
WHEREAS, the Commission has determined that it is necessary
to make certain improvements to the landfill site for the purpose
of meeting environmental requirements including closure and
post-closure for the hazardous waste portion of the landfill, and
WHEREAS, the Commission has negotiated with the Black Hawk
County Board of Supervisors for the issuance of general obligation
bonds to pay the costs of such improvements, and the Commission
will reimburse Black Hawk County from revenues of the Solid Waste
Management Commission for the costs of the annual debt service on
said general obligation bonds, and
WHEREAS, the Black Hawk County Board of Supervisors has
requested that each member city agree to pay their pro-rata share
of the costs of said bonds should there be insufficient revenues
from the operation of the Commission.
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The proposed agreement between the Commission and Black
Hawk County, which is attached hereto and is by this reference
made a part hereof, is specifically ratified and approved.
2. The Mayor and City Clerk are hereby authorized and
directed to sign the agreement on behalf of the City and to
transmit a copy of this Resolution to the Commission.
PASSED AND ADOPTED this 18th day of July, 1988.
