n RESOLUTION OF INTENT AS RELATED TO ORDINANCE NO. 3562 ,
AN ORDINANCE IMPOSING A TAX WITHIN THE CITY OF WATERLOO,
IOWA, OF ONE PERCENT ( 1%) UPON LOCAL SALES AND SERVICES

REVENUE SHALL BE DERIVED AND ALLOCATED IN ACCORDANCE
,72 WITH CHAPTER 422b OF THE CODE OF IOWA ( 1987 ) , ADOPTED BY
co THE WATERLOO CITY COUNCIL ON JUNE 20 , 1988 .
WHEREAS, Ordinance No. 3562 , an Ordinance Imposing a Tax
Within the City of Waterloo, Iowa, of One Percent ( 1%) Upon Local
Sales and Services to Become Effective January 1 , 1989 , and
Providing that Revenue Shall be Derived and Allocated in
Accordance with Chapter 422b of the Code of Iowa ( 1987 ) , was
adopted by the Waterloo City Council on June 20, 1988 , and
WHEREAS, Communities United for Property Tax Reduction have
approached the Council concerning said Ordinance, and
WHEREAS, the City Council of the City of Waterloo, Iowa, is
desirous of clarifying the intent and meaning of said Ordinance.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the following clarification be noted:
1. Section 2. Distribution.
Paragraph B. It was the intent that only existing
streets and infrastructure will be considered for 25
percent of the local option fee. New streets and
infrastructure shall not be considered for funding by
said local option tax.
2 . Section 3 .
Paragraph D. Should the City Council and Quality of
Life Commission not agree as to said Commission' s
recommendation, any unallocated or excess funds should
be allocated back for direct property tax relief .
3 . Section 4 . Sunset Provision Intent.
In addition to Iowa Code, at any time from and after the
date of imposition of the tax, the City Council shall,
by a seventy-five ( 75 ) percent majority vote, resubmit
the imposition of the local sales and service tax to a
public referendum.
PASSED AND ADOPTED this 12th day of September, 1988 .
