RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION,
PERMANENT AND TEMPORARY EASEMENT CONTRACTS TO SELL REAL
PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN
DEEDS AND EASEMENTS.
WHEREAS, the City of Waterloo, Iowa, has had the parcels
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcels
are necessary to carry out the Cleveland Street Reconstruction
Project, in connection with the Interstate Substitution Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcels
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which are situated in the City of Waterloo, Black
Hawk County, Iowa, are accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreement to purchase the properties from the
owners thereof, and the deeds for the conveyance of the same are
also accepted and approved and the City of Waterloo is directed to
pay for the properties and the incidental expenses necessary to
the consummation of the sales from City Funds.
The subject parcels are:
Parcel No. 5 - Partial Acquisition
Kenneth and Violet Simon, Owners
Part of Lot No. Nine ( 9 ) in Block No. Sixteen ( 16 ) in
"Hagerman Place" , in the City of Waterloo, Iowa, described as
follows:
Beginning at the Southwest corner of said Lot No. 9 ; thence
North along the West line thereof a distance of 20 feet;
thence South 63 degrees East 18 . 2 feet to the Southeasterly
line of said Lot 9 ; thence along said Southeasterly line 20
feet to the point of beginning.
Parcel No. 6 - Total Acquisition
Washland Leasing Service, Owner
All of Lot Nos . Twenty-four ( 24 ) and Twenty-five ( 25 ) , in
Block No. Two ( 2 ) , in Hagerman Place, in the City of
Waterloo, Iowa.
Parcel No. 8 - Partial Acquisition
Richard and Donna Clabby, Owners
Part of Lot No. Eleven ( 11 ) , Block No. One ( 1) in Hagerman
Place, in the City of Waterloo, Iowa, described as follows:
Beginning at the Northwest corner of said Lot No. 11 ; thence
East along the North line thereof a distance of 7 feet;
thence South 45 degrees West 9. 9 feet to the West line of
said Lot No. 11 ; thence North 7 feet to the point of
beginning.
Parcel No. 14 - Partial Acquisition
Joe Minard, Owner
The West 10 feet of the east 28 feet of Lot No. Three Hundred
Twenty-one ( 321 ) , in Galloway, in the City of Waterloo,
excepting therefrom all area occupied by buildings.
