RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF
CERTAIN REAL PROPERTY GENERALLY LOCATED WEST OF EAST
PARK AVENUE AND NORTH OF THE CEDAR RIVER TO THE NATIONAL
BANK OF WATERLOO FOR $6 , 093 . 00 , PLUS COSTS AND
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND
DELIVER A DEED FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property in the sum of $6, 093 . 00 , plus costs, has been made by The
National Bank of Waterloo, Waterloo, Iowa, and
WHEREAS, a public hearing was held on September 19 , 1988 , at
7 : 00 P.M. in the Council Chambers in City Hall, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to sell and convey premises owned by the City of
Waterloo, Iowa to the National Bank of Waterloo, Waterloo, Iowa,
and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1 . The following described real property, as fully
described in the published notice in the Waterloo Courier on
September 9 , 1988 , is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its ownership
is serving no municipal purpose, and
2 . That the offer of the National Bank of Waterloo to
purchase real property for the sum of $6 , 093 . 00 and costs be, and
it is hereby accepted for real property described below:
That part of Lots Nos. Eight ( 8) , Nine ( 9) and Ten ( 10 ) in
Block No. Five ( 5 ) and part of vacated Water Street, all in
the Original Plat on the East Side of the Cedar River, in the
City of Waterloo, Black Hawk County, Iowa, described as
follows :
Commencing at a point on the Northwesterly line of said Block
No. Five ( 5 ) that is 77 . 02 feet Southwesterly of the
Northerly corner of said Block No. Five ( 5) ; thence
Southeasterly at right angles to the Northwesterly line of
said Block No. Five ( 5 ) a distance of 160 . 00 feet; thence
Southwesterly along a line which is parallel with the
Northwesterly line of said Block No. Five ( 5 ) a distance of
147 . 45 feet to the point of beginning; thence S. 45°00 ' 00" E.
a distance of 138 . 71 feet to the Southeasterly line of said
Lot No. Ten ( 10 ) ; thence S. 45°00 ' 00" W. along the
Southeasterly line of said Lot No. Ten ( 10 ) and an extension
thereof a distance of 110 . 00 feet; thence N. 45°00 ' 00" W. a
distance of 138 . 71 feet to a point which is 160 . 00 feet
normally distant from the Northwesterly line of said Block
No. Five ( 5 ) ; thence N. 45°00 ' 00" E. parallel to the
Northwesterly line of said Block No. Five ( 5 ) a distance of
110 . 00 feet to the point of beginning.
The Northwesterly line of Block No. Five ( 5 ) , Original Plat on
the East Side of the Cedar River, in the City of Waterloo,
Black Hawk County, Iowa, is assumed to bear S. 45°00 ' 00" W;
3 . That the City of Waterloo, Iowa, convey said parcel of
real property to the National Bank of Waterloo by Quit Claim Deed.

4 . That the Mayor and City Clerk are hereby authorized to
execute and deliver deed to the National Bank of Waterloo.
5. That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council.
6 . That the City Clerk is authorized and directed to
deliver said deed of conveyance to the National Bank of Waterloo
upon receipt of the sum of $6,093 . 00 , and costs.
7 . That the National Bank of Waterloo agrees to convey to
the City of Waterloo real property generally located at the
southwest corner of the intersection of Water Street and East
Fifth Street, legally described as follows:
The Southeasterly Ninety-eight and One-half ( 98-1/2 ) feet of
the Northeasterly Ninety-six ( 96 ) feet of the Fractional
Block opposite Block No. Three ( 3 ) , in the Original Plat on
the East Side of the Cedar River, in the City of Waterloo,
Black Hawk County, Iowa, excepting the Northeasterly Eight
( 8 ) inches thereof.
Also all of that part of the Southeasterly Twenty-two ( 22 )
feet of the Northwesterly Eighty-two ( 82 ) feet of the
Southeasterly One Hundred Forty-four and one-half ( 144-1/2 )
feet of the Northwesterly Two Hundred Eighty-five ( 285 ) feet
of the Fractional Block opposite Block No. Three ( 3 ) , in the
Original Plat, on the East Side of the Cedar River, in the
City of Waterloo, Black Hawk County, Iowa, lying
Northeasterly of the present river bank as defined by stone
wall now constructed and Southwesterly of a line which is
parallel with and Ninety-six ( 96 ) feet distant from the
Southwesterly line of Water Street;
Also the Northwesterly Eight ( 8 ) feet of the Southeasterly
Twenty-two ( 22 ) feet of the Northwesterly Eighty-two ( 82)
feet of the Southeasterly One Hundred Forty-four and one-half
( 144-1/2 ) feet of the Northwesterly Two Hundred Eighty-five
( 285 ) feet of the Northeasterly Ninety-six ( 96 ) feet of said
Fractional Block;
Also that part of said Fractional Block bounded as follows:
Commencing at a point in the Northwesterly line of Fifth
Street which is Ninety-six ( 96 ) feet Southwesterly of the
Southwesterly line of Water Street; running thence
Northwesterly along a line which is parallel with the
Southwesterly line of Water Street a distance of Eighty-two
and five tenths ( 82 . 5 ) feet; thence at right angles
Southwesterly a distance of Twenty-two and seventy-five
hundredths ( 22 . 75 ) feet; thence Southeasterly to a point in
the Northwesterly line of Fifth Street Twenty-seven and
twenty-five hundredths ( 27 . 25) feet Southwesterly of the
point of beginning; thence Northeasterly along the
Northwesterly line of Fifth Street a distance of Twenty-seven
and twenty-five hundredths ( 27 . 25 ) feet to the place of
beginning.
Also that part of said Fractional Block bounded as follows :
Commencing at a point which is Ninety-six ( 96 ) feet
Southwesterly (measured along the Northwesterly line of
Fifth Street) of the Southwesterly line of Water Street and
Eighty-two and five tenths ( 82 . 5 ) feet Northwesterly
(measured along a line which is at right angles to Fifth
Street) of the Northwesterly line of Fifth Street; running
thence Northwesterly along a line which is parallel with the

Southwesterly line of Water Street a distance of Two ( 2 )
feet; thence at right angles Southwesterly to the Cedar
River; thence Southeasterly along the Cedar River to a point
which is Eighty-two and five tenths ( 82 . 5 ) feet
Northwesterly (measured along a line which is at right angles
to Fifth Street) of the Northwesterly line of Fifth Street;
thence Northeasterly to the place of beginning;
together with a donation of $2, 000. 00 to the Park Board for
landscape improvements for said property.
