HomeMy WebLinkAbout1988-574-10.10.1988 RESOLUTION NO. 1988-574 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACTS FOR PERMANENT AND TEMPORARY EASEMENTS TO THE CITY AND ACCEPTING AND APPROVING CERTAIN EASEMENTS. WHEREAS, the City of Waterloo, Iowa, has had all the parcels described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described permanent and temporary easements are necessary to carry out the East Park Avenue Parking Lot Improvements, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcels hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the permanent easements for the properties from the owners thereof , and the permanent easements for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sales from City funds . The subject parcels are: Permanent Easement--National Bank of Waterloo, Owner Construction, Maintenance, Repair, and Operation of ten ( 10 ) foot storm water Easement That part of vacated Water Street in the Original Plat on the East Side of the Cedar River, in the City of Waterloo, Black Hawk County, Iowa, described as follows: Beginning at a point on the Northwesterly Right-of-Way line of East Park Avenue which is 14 . 80 feet Northeasterly of the Southwesterly line of said vacated Water Street; thence N. 45°00 ' 00" W. a distance of 75 . 00 feet; thence N. 45°00 ' 00" E. a distance of 10 . 00 feet; thence S. 45°00 ' 00" E. a distance of 75 . 00 feet to said Northwesterly Right-of-Way line of East Park Avenue; thence S. 45°00 ;00" W. along said Northwesterly Right-of-Way line a distance of 10 . 00 feet to the point of beginning.
