HomeMy WebLinkAbout1988-617-11.07.1988 RESOLUTION NO. 1988-617 RESOLUTION ACCEPTING AND APPROVING A CERTAIN ACQUISITION, PERMANENT AND TEMPORARY EASEMENT CONTRACT TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING A CERTAIN DEED AND EASEMENT. WHEREAS, the City of Waterloo, Iowa, has had all of the parcel described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcel is necessary to carry out the Hackett Road Bypass Project in connection with the Interstate Substitution Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcel hereinafter described to sell the same to the City of Waterloo, Iowa, all of which is situated in the City of Waterloo, Black Hawk County, Iowa, is accepted and approved and the Mayor and the City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the property from the owner thereof , and the deed for the conveyance of the same is also accepted and approved and the City of Waterloo is directed to pay for the property and the incidental expenses necessary to the consummation of the sale from City funds. The subject parcel is: Parcel No. AK - Temporary Easement Dennis Liger, Owner Temporary Easement "A" The Southwesterly 15 feet in even width of the Northeasterly 20 feet in even width of the following described parcel: The West 90 feet of the East 170 feet in even width of Lot No. 39 in Auditor ' s Whitney Road Plat in Section 16 and 21-89-13 West of the Fifth Principal Meridian, in the Town of Castle Hill, Black Hawk County, Iowa (now in the City of Waterloo, Iowa) . Containing approximately 1 , 503 S.F. Temporary Easement "B" The Northeasterly 25 feet in even width of the Easterly 80 feet in even width of Lot No. 39 , Auditor ' s Whitney Road Plat, in Sections 16 and 21-89-13 West of the Fifth Principal Meridian, in the Town of Castle Hill, Black Hawk County, Iowa (now in the City of Waterloo, Iowa) . Excepting therefrom the following described parcel: Beginning at the Northeast corner of said Lot 39 ; thence Southerly along the East line of said Lot 39 to a point which is 7 feet normally distant Southwesterly from the Northeast line of Lot 38 , Auditor ' s Whitney Road Plat; thence Northwesterly 20 feet to a point which is 5 feet normally distant Southwesterly from the Northeast line of said Lot 39 ; thence Northwesterly along a line that is parallel with the Northeast line of said Lot 39 to the West line of the East 80 feet of said Lot 39 ; thence Northerly along the West line of the East 80 feet of said Lot 39 to the Northeast line of said Lot 39 ; thence Southeasterly along the Northeast line of said Lot 39 to the point of beginning; Containing approximately 1 ,759 S.F.
