RESOLUTION NO. 2024-581 RESOLUTION APPROVING THE REQUEST OF JESSE THOMPSON FOR A WAIVER FOR A CONCRETE DRIVEWAY, LOCATED AT 313 W. ORANGE ROAD, WITH THE ELIMINATION OF THE SIDEWALK SECTION DUE TO INABILITY TO MEET GRADE REQUIREMENTS. WHEREAS, the City Engineer has made a written application to the City Council asking that Jesse Thompson, be authorized and permitted to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 313 W. Orange Road, and legally described as follows: THAT PART OF THE NORTHWEST QUARTER OF SECTION NO. 21, TOWNSHIP 88 NORTH, RANGE 13 WEST OF THE 5TH P.M., BLACK HAWK COUNTY, IOWA, BOUNDED AS FOLLOWS: COMMENCING AT A POINT WHICH IS 1753 FEET WEST OF A POINT WHICH IS 29 17/27 RODS WEST OF THE NORTHEAST CORNER OF SAID SECTION; RUNNING THENCE WEST ALONG THE NORTH LINE OF SAID SECTION A DISTANCE OF 133 FEET; THENCE SOUTH A RIGHT ANGLE A DISTANCE OF 385 FEET; THENCE EAST PARALLEL WITH THE NORTH LINE OF SAID SECTION A DISTANCE OF 133 FEET; THENCE NORTH 385 FEET TO THE POINT OF BEGINNING; EXCEPT THE NORTH 40 FEET THEREOF CONVEYED FOR ROAD PURPOSES. WHEREAS, it is the sense of the Council of the City of Waterloo,Iowa, that said request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Waterloo as follows: 1. That permission is hereby granted to Jesse Thompson, to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 313 W. Orange Road, subject to the following conditions: 2. Work is to be performed by an approved and bonded contractor. 3. A permit is to be obtained from the office of the City Engineer prior to construction. 4. All work shall be under the supervision of the City Engineer and at no cost to the City of Waterloo. 5. The City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record. 6.
