RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF HY-VEE,
INC. TO REZONE FROM "R-3" MULTIPLE RESIDENCE
DISTRICT TO "R -3,C -Z" CONDITIONAL ZONING
DISTRICT APPROXIMATELY 0.62 ACRES GENERALLY
LOCATED ACROSS THE STREET AND WEST OF 3233
WEST 4TH STREET, AS AUGUST 1, 2011, AT 5:30
P.M. IN THE COUNCIL CHAMBERS IN CITY HALL AND
INSTRUCTING CITY CLERK TO PUBLISH NOTICE OF
HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5:30 p.m. on the l5t day of August, 2011, for
the purpose of considering and acting upon an application of
Hy -Vee, Inc. to rezone from "R-3" Multiple Residence District to
"R -3,C -Z" Conditional Zoning District approximately 0.62 acres
generally located across the street and west of 3233 West 4th
Street, and legally described as follows:
A survey of a tract of land in the Southeast Quarter of
the Southeast Quarter (SE 1✓, SE 1-4), of Section 33,
Township 89 North (T89N), Range 13 West (R13W) of the
Fifth Principal Meridian (5th P.M.), in the City of
Waterloo, Black Hawk County, State of Iowa, more
particularly described as follows:
Beginning at a point 175.15 feet South and 658.05 feet
East of the Northwest corner of said Southeast Quarter
of the Southeast Quarter (SE '-,4, SE 1'); thence East 462
feet to the centerline of former primary Highway No.
U.S. 63, also known as Waterloo & Eldora Road, and now
known as West Fourth Street; thence South 53 degrees 28
minutes West along the centerline of said road 150
feet; thence North 84 degrees 27 minutes West 407 feet;
thence North 34 degrees 57 minutes East 82.75 feet to
the point of beginning, except the public right of way
of West Fourth Street as presently established, all in
the City of Waterloo, Black Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
Notice of the time and place of said hearing in the Waterloo
Courier.
