o RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND
NOTICE TO BE GIVEN ON THE VACATION, SALE AND CONVEYANCE
E' H -, OF UNIMPROVED N. JANNEY AVENUE AS PLATTED SOUTH OF
ALABAR AVENUE AS DECEMBER 19 , 1988 , AT 7 : 00 P.M. IN CITY
HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 7 : 00 p.m. on the 19th day of December, 1988 , for the
purpose of considering and acting upon a proposal to vacate, sell
and convey unimproved N. Janney Avenue as platted south of Alabar
Avenue owned by the City of Waterloo, Iowa, to Max E. and Helen M.
Guernsey and William H. and Beverly R. Orton, and legally
described as follows:
To Max E. and Helen M. Guernsey:
The West one-half of the East Thirty ( 30 ) feet of the west
Forty-five ( 45 ) feet of that part of Janney Avenue lying
north of the south line of vacated Hartman Avenue and lying
south of a line described as beginning at a point on the west
line of said east Thirty ( 30 ) feet of the West Forty-five
( 45 ) feet of said Janney Avenue, said point lying One Hundred
Forty-two and Eighty-six Hundredths ( 142 . 86 ) feet North of
the South line of vacated Hartman Avenue; thence
Southeasterly to a point on the east line of said east Thirty
( 30 ) feet of West Forty-five ( 45 ) feet of said Janney Avenue,
said point lying One Hundred Fifty-seven ( 157 ) feet radially
distant and southwesterly of the centerline of U.S. Highway
No. 218 as described in L.D. 491 , Page 369, Black Hawk County
Recorder ' s office, Black Hawk County, Iowa, with the City' s
retention of a permanent easement over, under and above the
above described parcel;
for $214 . 50 , plus costs;
and to William H. and Beverly R. Orton:
The east one-half of the east thirty ( 30 ) feet of the west
forty-five feet of that part of Janney Avenue lying north of
the south line of vacated Hartman Avenue and lying south of a
line described as beginning at a point on the west line of
said east thirty ( 30 ) feet of west forty-five ( 45 ) feet of
said Janney Avenue, said point lying one hundred forty-two
and eighty-six hundredths ( 142 . 86 ) feet north of the south
line of vacated Hartman Avenue; thence southeasterly to a
point on the east line of said east thirty ( 30 ) feet of west
forty-five ( 45 ) feet of said Janney Avenue, said point lying
one hundred fifty-seven ( 157) feet radially distant and
southwesterly of the centerline of U.S. Highway No. 218 as
described in L.D. 491 , page 369 , Black Hawk County Recorder ' s
Office, Black Hawk County, Iowa, with the City' s retention of
a permanent easement over, under and above the above
described parcel;
for $214 . 50 , plus costs.
Section 2 . That the City Clerk is hereby directed to publish
notice of the time and place of said hearing in the Waterloo
Courier.
PASSED AND ADOPTED this 21st day of November, 1988 .
