RESOLUTION GRANTING EASEMENT FOR INGRESS AND EGRESS TO
REAL PROPERTY LOCALLY KNOWN AS 2642 WCF & N DRIVE, IN
THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA.
WHEREAS, the City of Waterloo did acquire, by Warranty Deed,
the East 15 . 0 feet of the West 80 . 0 feet of the S 1/2 of the S 1/2
of the NW 1/4 of the SW 1/4 of the NE 1/4 of Section 10 , T89N,
R13W of the Fifth Principal Meridian in the City of Waterloo,
Black Hawk County, Iowa, which Warranty Deed was filed for record
on September 29 , 1987 in 552 LD 823 , and
WHEREAS, the City of Waterloo has not, at this time, formally
accepted said 15 feet into the city street system, and
WHEREAS, Stacey A. Wilson, a single person, is now in the
process of purchasing a home located at 2642 WCF & N Drive, which
property is adjacent to said 15 feet, as described above, and
WHEREAS, the proposed buyer is desirous of obtaining a
written authorization to gain access to said real estate pending
the formal approval, by the Planning, Programming and Zoning
Commission and the City Council to accept all of the real estate
acquired for the WCF & N Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that:
1. An easement for ingress and egress on and over the East
15 . 0 feet of the West 80 . 0 feet of the S 1/2 of the S 1/2
of the NW 1/4 of the SW 1/4 of the NE 1/4 of Section 10 , T89N,
R13W of the Fifth Principal Meridian in the City of Waterloo,
Black Hawk County, Iowa, is hereby granted to the owner( s) of said
real estate, locally known as 2642 WCF & N Drive.
2 . That said easement for ingress and egress shall be
considered to be permanent in nature and shall be considered to be
in existence until such time as the City Council of the City of
Waterloo formally accepts the entire real estate which had been
acquired for the WCF & N Project.
PASSED AND ADOPTED this 21st day of November, 1988 .
