Hy` RESOLUTION REQUIRING EXCEPTIONAL PERSONS, INC. TO

RECONSTRUCT THE DRAINAGE DITCH AT 1325-1327 BLACK HAWK
ROAD.
WHEREAS, the drainage ditch on the City' s right of way on the
property of 1325-1327 Black Hawk Road was filled by the owner,
Exceptional Persons, Inc. ; and
WHEREAS, the filling of the drainage ditch has caused
problems with the natural flow of the water and has caused ponding
in the street; and
WHEREAS, Exceptional Persons , Inc. has been contacted by city
employees on various occasions regarding the situation, including:
Letters from J.D. Fallis of the Engineering Office on May 26 ,
1988 , and August 2 , 1988 ; and

sr Letters from the City Attorney' s office on July 14 , 1988 , and
IJ October 20 , 1988 ; and
~ ' WHEREAS, none of the City' s attempts to correct this
situation have resolved the problem; and
WHEREAS, the filling of the drainage ditch and the ponding in
the street is a safety hazard; and
WHEREAS, Section 24-6 of the Code of Ordinances of the City
of Waterloo authorizes the City Council, by Resolution, to order
the owner or lessee to construct a drain within the time to be
designated by the Council; and if the owner or lessee does not
construct the drain in the time and manner required, the City may
at once proceed to build the drain and report the expense and all
costs arising therefrom, to the Council, whereupon the Council may
by resolution, levy and assess the expenses as a special tax upon
the property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that:
1 . Exceptional Persons, Inc. shall excavate the ditch and
grade the shoulder to match the elevations which existed prior to
construction at 1325-1327 Black Hawk Road in a manner to be
approved by the City Engineer ' s Office.
2. In the event Exceptional Persons, Inc. does not excavate
and grade the drainage ditch within ten ( 10 ) days of the date of
this Resolution, the City shall perform the necessary work and the
expense thereof shall be assessed as a special tax upon the
property.
