S + n RESOLUTION APPROVING ACCESS AGREEMENT WITH GILBRALTER
n,E HL_ INVESTMENTS, INC. AND HERITAGE TRUST IN CONJUNCTION WITH
� THE ACQUISITION OF RIGHT-OF-WAY FOR ANSBOROUGH AVENUE
`c1 - RECONSTRUCTION PROJECT, IX-6615 ( 6 ) --79-07, AND DIRECTING
Pc) c- EXECUTION OF SAID AGREEMENT BY MAYOR.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the Access Agreement dated December 12 , 1988, to grant the
Pronto Station, located between West Fourth Street and Ridgeway
Avenue, ingress and egress over a portion of City-owned property
legally described as follows :
A part of the Southeast 1/4 of the Southeast 1/4 of Section
33 , Township 89 North, Range 13 West of the Fifth Principal
Meridian, Waterloo, Black Hawk County, Iowa, lying within the
following described boundary:
Commencing at a point which is 304 . 40 feet North and 63 . 10
1 feet West of the Southeast corner of said Section 33 ; thence
North 02°45 ' 20" East a distance of 56 . 96 feet to the point of
beginning of the parcel herein described; thence continuing
Hp North 02°45 ' 20" East a distance of 28 . 20 feet to a point
H,, which is 59. 00 feet West of the East line of said Section 33 ;
E thence North 78°00 ' 00" West a distance of 33 . 50 feet; thence
South 02°45 ' 20" West a distance of 28 . 20 feet; thence South
78°00 ' 00" East a distance of 33 . 50 feet to the point of
beginning.

The East line of the Southeast 1/4 of said Section 33 is
assumed to bear due North and South;
by and between Gilbralter Investments, Inc. and Heritage Trust,
and the City of Waterloo, Iowa, be and the same is hereby
approved, and the Mayor authorized to execute the same in behalf
of the City of Waterloo, Iowa.
PASSED AND ADOPTED this 12th day of December, 1988 .
