RESOLUTION FIXING THE TIME AND PLACE OF HEARING TO BE
GIVEN ON APPLICATION OF RUSSELL AND ANN FOLKERS DBA R &
A TRUCKING ENTERPRISES, INC. TO REZONE FROM "A-1"
AGRICULTURAL DISTRICT TO "M-2 ,P" PLANNED INDUSTRIAL
DISTRICT A PARCEL OF LAND GENERALLY LOCATED ALONG THE
SOUTH SIDE OF NEWELL STREET AND IMMEDIATELY WEST OF
DIXIANA MOTOR LINES, INC. , AS JANUARY 9 , 1989 , AT 7 : 00
P.M. IN THE COUNCIL CHAMBERS IN CITY HALL AND
INSTRUCTING CLERK TO PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 7 : 00 p.m. on the 9th day of January, 1989 , for
the purpose of considering and acting upon an application of
Russell and Ann Folkers dba R & A Trucking Enterprises, Inc. , to
rezone from "A-1" Agricultural District to "M-2 ,P" Planned
Industrial District a parcel of land generally located along the
south side of Newell Street and immediately west of Dixiana Motor
Lines, Inc. and legally described as follows :
A parcel of land located in the E 1/2 of the NE 1/4 and in
the NE 1/4 of the SE 1/4 of Section 20-89-12 , Waterloo, Black
Hawk County, Iowa, described as follows:
Commencing at the Northeast corner of said E 1/2 of the NE
1/4 ; thence S. 89°34 ' 04" W. along the North line of said E
1/2 of the NE 1/4 a distance of 330 . 00 feet to the point of
beginning; thence S. 01°00 ' 30" E. parallel with the East line
of said E 1/2 of the NE 1/4 a distance of 2378 . 82 feet to the
Northerly right-of-way line of the Chicago Northwestern
Transportation Company; thence S. 69°35 ' 50" W. along said
Northerly right-of-way line a distance of 1045 . 50 feet to the
West line of said NE 1/4 of the SE 1/4 ; thence N. 01°07 ' 22"
W. along said West line a distance of 85 . 32 feet to the
Northwest corner of said NE 1/4 of the SE 1/4 ; thence N.
01°03 ' 30" W. along the West line of said E 1/2 of the NE 1/4
a distance of 2144 . 43 feet to a point 506 . 51 feet Southerly
of the North line of said E 1/2 of the NE 1/4 ; thence N.
89°34 ' 04" E. parallel with the North line of said E 1/2 of
the NE 1/4 a distance of 276 . 00 feet; thence N. 01°03 ' 30" W.
parallel with the West line of said E 1/2 of the NE 1/4 a
distance of 506 . 51 feet to the North line of said E 1/2 of
the NE 1/4 ; thence N. 89°34 ' 04" E. along the North line of
said E 1/2 of the NE 1/4 a distance of 712 . 71 feet to the
point of beginning, and excepting, therefrom, all legal
highways .
The North line of the E 1/2 of the NE 1/4 , Section 20-89-12
is assumed to bear N. 89°34 ' 04" E.
and also,
A parcel of land located in the E 1/2 of the NE 1/4 of
Section 20-89-12 , Waterloo, Black Hawk County, Iowa,
described as follows:
Beginning at the NW corner of said E 1/2 of the NE 1/4 ;
thence S. 01°03 ' 30" E. along the West line of said E 1/2 of
the NE 1/4 a distance of 506 . 51 feet; thence N. 89°34 ' 04" E.
parallel with the North line of said E 1/2 of the NE 1/4 a
distance of 276 . 00 feet; thence N. 01°03 ' 30" W. parallel with
the West line of said E 1/2 of the NE 1/4 a distance of
506 . 51 feet to the North line of said E 1/2 of the NE 1/4 ;
thence S. 89°34 ' 04" W. along said North line a distance of

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
Co WATERLOO, IOWA, that the City Clerk is hereby directed to publish
notice of the time and place of said hearing in the Waterloo
Courier.
