BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
- -Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 7 : 00 p.m. on the 9th day of January, 1989 , for the purpose
of considering and acting upon a proposal to vacate a portion of
Arbor Street owned by the City of Waterloo, Iowa, and legally
described as follows:
The Street conveyed to the City of Waterloo on July 3 , 1951
and known as Arbor Street extending from the northeasterly
line of Commercial Street to a line 20 feet west of and
parallel to the east line of Lots 34 and 35 in South Waterloo
Addition, said street being 50 feet in width;
and to sell and convey to Waterloo Lumber Company a portion of
Arbor Street, legally described as follows:
The south and southeasterly one-half of that street conveyed
to the City of Waterloo on July 3 , 1951 and known as Arbor
Street extending from the northeasterly line of Commercial
Street to a line 20 feet west of and parallel to the east
line of Lots 34 and 35 in South Waterloo Addition, said
street being 50 feet in width, all in the City of Waterloo,
Black Hawk County, Iowa;
with the City' s retention of a permanent utility easement over,
under and above the above described parcel;
for $800 . 00 plus costs;
and to sell and convey to Iowa Terminal and Warehouse, Inc.
(Kroblin Refrigerated Express ) a portion of Arbor Street, legally
described as follows :
The north and northwesterly one-half of that street conveyed
to the City of Waterloo on July 3 , 1951 and known as Arbor
Street extending from the northeasterly line of Commercial
Street to a line 20 feet west of and parallel to the east
l'.ne of Lots 34 and 35 in South Waterloo Addition, said
street being 50 feet in width, all in the City of Waterloo,
Black Hawk County, Iowa;
with ti-e City' s retention of a permanent utility easement over,
under and above the above described parcel;
for $800 . 00 plus costs .
Section 2 . That the City Clerk is hereby directed to publish
notice of the time and place of said hearing in the Waterloo
Courier.
PASSED AND ADOPTED this 19th day of December, 1988 .
