RESOLUTION NO. 2011-475 RESOLUTION MAKING ASSESSMENT FOR WORK PERFORMED BY THE WATER WORKS. WHEREAS, the Board of Water Works Trustees of the City of Waterloo, Iowa, did, as provided by law, notify by written notice the property owner of the premises described below to have the repairs completed and further damage prevented, and WHEREAS, the property owner failed to comply with the order of the Board of Water Works Trustees, as by law provided, and WHEREAS, the Board of Water Works Trustees proceeded to have the work done on the premises described below, in the City of Waterloo, Iowa, to comply with Ordinance No. 1118 of the City of Waterloo, Iowa, and WHEREAS, the Board of Water Works Trustees filed with the City Clerk on the 23rd day of May, 2011, a report filing claim for the repairs and preventing further damage at the below described premises and same met all the requirements of the City ordinance and have been fully completed. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the said report of the Board of Water Works Trustees be, and the same is hereby, approved; that the work was done under and by virtue hereby, accepted, and that the cost of said work is hereby determined to be as follows, which amount can be assessed over a ten-year period against the property: Dennis G. Lester and Linda D. Lester, Owners 3117 Tulip Lane, Waterloo, Iowa Legal Description: Lot No. Sixty-four (64) in Southdale, Waterloo, Black Hawk County, Iowa. Unpaid Assessment: $341.99 R. J. Spain and Ruby Spain, Owners 127 Conger Street, Waterloo, Iowa Legal Description: Part of Lots 11, 12 and 13, Cowin's Addition, in the City of Waterloo, Black Hawk County, Iowa, lying within the following described boundary: beginning at the Northeast corner of said Lot 11; thence Southwesterly along a straight line to a point on the West line of said Lot 11 which point is 23.05 feet South of the Northwest corner of said Lot 11; thence southwesterly along a straight line to a point on the West line of said Lot 12 which point is 51.45 feet South of the Northwest corner of said Lot 12; thence Southwesterly along a straight line to a point on the Southwesterly line of said Lot 13 (the Northeasterly right of way line of the Illinois Central Railroad) which point is 52.21 feet Northwesterly from the Southeast corner of said Lot 13; thence Southeasterly along the Resolution No. 2011-475 Page 2 Southwesterly line of said Lots 12 & 13 to the South line of said Lot 12; thence East along the South line of said Lots 11 & 12 to the Southeast corner of said Lot 11; thence North along the East line of said Lot 11 to the point of beginning. Unpaid Assessment: $3,450.00 Cloratee Culpepper, Karl Culpepper and Erica Culpepper, Owners 120 Conner Street, Waterloo, Iowa Legal Description: Lot No. Eight ( 8 ) in Block No. Nine ( 9 ) in "East Park Place" in the City of Waterloo, Black Hawk County, Iowa. Unpaid Assessment: $3,450.00 Craig L. Chapman, Owner 1918 Svcamore Street, Waterloo, Iowa Legal Description: Lot No. Three (3), in Block No. Three (3), in "Lake Side Addition" to Waterloo, Iowa, Black Hawk County. Unpaid Assessment: $2,700.62 Rosa Lee Ross, Contract Purchaser Mitchell Ross, Deed Holder 200 Merriman Street, Waterloo, Iowa Legal Description: Shilliams 3rd Subdivision, West 66 feet, Lot 1, Block 10, City of Waterloo, Black Hawk County. Unpaid Assessment: $5,791.35 BE IT FURTHER RESOLVED that there be, and are hereby assessed and levied a special tax and assessment against the property improved in the City of Waterloo, Iowa, said assessment shall bear interest from the date of levy of the assessment, viz: June 6, 2011, at the rate of nine (9) percent per annum until paid on all the unpaid amount of this assessment certified to the County Treasurer of Black Hawk County, Iowa, and BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby instructed to notify the above described property owners of said property, accordingly and also instructed to certify said assessment to the County Treasurer of Black Hawk County, Iowa, to be entered upon the tax list to be collected as other taxes, as provided by law, and when collected to be credited to the Water Works Fund of said City, and assessment to be made over a ten- year period.
