RESOLUTION NO. 2024-728 A RESOLUTION APPROVING THE SALE AND CONVEYANCE OF CITY-OWNED PROPERTY LOCATED AT 1515 SYCAMORE STREET AND A PORTION OF VACATED ELM STREET TO 1515 SYCAMORE, LLC, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS, the City of Waterloo is the owner of certain real property located at 1515 Sycamore Street consisting of 2.1665 acres and a portion of vacated Elm Street consisting of 0.4049 acres(hereinafter referred to as the "Property"); and WHEREAS, 1515 Sycamore, LLC has shown interest in purchasing the Property for purposes that will benefit the community;and WHEREAS,the City Council of Waterloo, Iowa, has determined that it is in the best interest of the City and its residents to sell and convey the Property to 1515 Sycamore, LLC for the sum of $1.00; and WHEREAS, the terms and conditions of the sale have been negotiated and agreed upon by the City and 1515 Sycamore, LLC; and WHEREAS, a public hearing on the proposed conveyance was held by the City Council as required by law. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo as follows: 1. The sale and conveyance of the Property legally described as follows: LOTS 1-12, BLOCK 4, AND ALL OF THE ALLEY IN BLOCK 4, RIVERSIDE ADDITION, CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA; AND THAT PORTION OF ELM STREET LYING SOUTHWESTERLY OF THE SOUTHWESTERLY RIGHT-OF-WAY LINE OF LAFAYETTE STREET AND LYING NORTHEASTERLY OF THE NORTHEASTERLY RIGHT-OF-WAY LINE OF SYCAMORE STREET, SUBJECT TO THE RETENTION OF A PUBLIC UTILITY EASEMENT OVER, UNDER, ACROSS AND UPON THE ABOVE DESCRIBED AREA. to 1515 Sycamore, LLC, is hereby approved. 2. Conveyance of that portion of the Property in Block 4 shall be by special warranty deed, and conveyance of vacated Elm Street shall be by quit claim deed. Resolution 2024-728 Page 2 3. The Mayor and City Clerk are authorized and directed to execute said document on behalf of the City of Waterloo, Iowa. 4. This resolution shall take effect upon its passage and approval.
