RESOLUTION NO. 2024-713
A RESOLUTION APPROVING THE REQUEST OF HASIB
REKIC FOR A WAIVER FOR A CONCRETE DRIVEWAY,
LOCATED AT 918 ROOSEVELT STREET, WITH THE
ELIMINATION OF THE SIDEWALK SECTION DUE TO
INABILITY TO MEET GRADE REQUIREMENTS.
WHEREAS, Hasib Rekic, the owner of property located at 918 Roosevelt Street,
Waterloo, Iowa, and legally described as follows:
AUDITOR BARNES PLAT OF MAYWOOD LOT FOURTY-EIGHT
(48), CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA.
has submitted a request for a waiver from the standard concrete driveway installation
requirements as prescribed by the City's municipal code; and
WHEREAS, the property in question is unable to accommodate the standard sidewalk
installation due to the inability to meet grade requirements, posing potential safety and structural
issues; and
WHEREAS, the City Council has reviewed the application and supporting
documentation provided by Hasib Rekic, including the feasibility studies regarding the grade
challenges associated with the sidewalk installation at this location; and
WHEREAS, it has been determined that granting the waiver for the concrete driveway
installation, along with the approval to eliminate the sidewalk section, will not adversely impact
the surrounding community and ensures proper property access and safety standards; and
WHEREAS, this waiver aligns with the city's commitment to practical and community-
conscious planning decisions; and
WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request
should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of
Waterloo as follows:
1. The request from Hasib Rekic for a waiver for the installation of a concrete driveway
at 918 Roosevelt Street is hereby approved, and the requirement for a standard sidewalk section
is waived due to an inability to meet grade requirements, subject to the following conditions:
a) Work is to be performed by an approved and bonded contractor.
b) A permit is to be obtained from the office of the City Engineer prior to
construction.
c) All work shall be under the supervision of the City Engineer and at no cost
to the City of Waterloo.
d) The City Clerk is authorized and directed to forward a certified copy of this
resolution to the Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a matter of official County Record.
e) This resolution shall take effect upon its passage and approval.
2. The City Engineer is authorized and directed to take necessary steps to implement this
