RESOLUTION NO. 2024-714
A RESOLUTION APPROVING THE REQUEST OF BRAD
STROH, FOR A WAIVER FOR A CONCRETE DRIVEWAY,
LOCATED AT 709 DEARBORN AVENUE.
WHEREAS, Brad Stroh, the owner of property located at 709 Dearborn Avenue,
Waterloo, Iowa, and legally described as follows:
SUNSHINE SUBDIVISION LOTS 6, 7 & 8 EXC THAT PART
THEREOF CONVEYED TO THE CITY OF WATERLOO, IOWA IN 569
CLD 650, CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA.
has submitted a request for a waiver from the standard concrete driveway installation
requirements as prescribed by the City's municipal code; and
WHEREAS, the property in question is located on an unimproved street and involves
placing the driveway or sidewalk on the city right-of-way; and
WHEREAS, there is a need to address potential future requirements for culvert
placement for ditch work, which shall be installed at the property owner's expense if deemed
necessary; and
WHEREAS, the City Council deems it in the interest of the public to approve such
waiver subject to specific conditions ensuring city infrastructure integrity and public safety.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of
Waterloo as follows:
1. The request for a waiver by Brad Stroh to construct a concrete driveway located at 709
Dearborn Avenue is hereby approved subject to the following conditions:
a) Work is to be performed by an approved and bonded contractor.
b) A permit is to be obtained from the office of the City Engineer prior to
construction.
c) All work shall be under the supervision of the City Engineer and at no cost
to the City of Waterloo.
d) The City Clerk is authorized and directed to forward a certified copy of this
resolution to the Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a matter of official County Record.
e) This resolution shall take effect upon its passage and approval.
2. Brad Stroh is authorized to commence construction of the concrete driveway including
the placement on the city right-of-way.
3. Any construction activity involving the right-of-way shall comply with all applicable
city regulations and standards to ensure safe usage and maintenance.
4. In the event that future ditch work requires culvert installation, it shall be the
responsibility of the property owner, Brad Stroh, to bear all associated expenses for the
placement thereof.
