RESOLUTION SETTING THE DATE OF PUBLIC HEARING AS JUNE
6, 2016 TO APPROVE THE REQUEST BY THE CITY OF
WATERLOO TO VACATE A PORTION-OF THE EXISTING 20 FOOT
WIDE ALLEY, LOCATED ADJACENT TO LOTS 3, 4, 5, 6, 7 AND 8
WITHIN BLOCK 16 OF HAYES ADDITION, AND AUTHORIZE SALE
.AND CONVEYANCE OF A PORTION TO JOEL C. CIZEK AND
CONNIE J. CIZEK FOR $372 AND A PORTION TO THE HEENE
FAMILY TRUST FOR$70.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS
FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa, shall meet in the Harold E.
Getty Council Chambers, City Hall, in the City of Waterloo, Iowa, at 5:30 p.m. on the 6t' day of
June, 2016, for the purpose of considering and acting upon a proposal to vacate a portion of the
existing 20 foot wide alley, located adjacent to Lots 3, 4, 5, 6, 7 and 8 within Block 16 of Hayes
Addition, and authorize sale and conveyance of a portion to Joel C. Cizek and Connie J. Cizek
for$372 and a portion to The Heene Family Trust for$70, and legally described as follows:
Alley vacate:
That portion of the platted 20-foot public alley in Block 16, Hayes Addition, City of
Waterloo, Black Hawk County,Iowa, lying southeasterly of a line drawn between the
northerly most corner of Lot 6 of said Block 16 and the westerly most corner of Lot 5 of
said Block 16 and lying northwesterly of a line drawn between the easterly most corner of
Lot 8 of said Block 16 and the southerly most corner of Lot 3 of said Block 16, subject to
the retention of an utility easement over, under and across the above described property.
Alley conveyance to Heene Family Trust:
tThat portion of the platted 20-foot public alley in Block 16,Hayes Addition, City of
Waterloo, Black Hawk County, Iowa, described as follows:
The southwesterly half of said alley lying southeasterly of a line between the northerly
most corner of Lot 8 in said Block 16 and the westerly most corner of Lot 3 in said Block
16 and northwesterly of the northeasterly extension of the southeasterly line of the
northwesterly 45 feet of said Lot 8, subject to the retention of an utility easement over,
under and across the above described property.
Alley conveyance to Joel C. Cizek and Connie J Cizek:
That portion of the platted 20-foot public alley in Block 16, Hayes Addition, City of
Waterloo, Black Hawk County, Iowa, lying southeasterly of a line drawn between the
northerly most corner of Lot 6 of said Block 16 and the westerly most corner of Lot 5 of
said Block 16,and lying northwesterly of a line drawn between the easterly most corner of
Lot 7 of said Block 16 and the southerly most corner of Lot 4 of said Block 16, subject to
the retention of an utility easement over, under and across the above described property.
Section 2. That the City Clerk is hereby directed„to publish notice of the time and place
of said hearing in the Waterloo Courier:--
