RESOLUTION NO. 2016-376 RESOLUTION RATIFYING, CONFIRMING AND APPROVING PUBLICATION OF NOTICE OF PUBLIC HEARING FOR THE ISSUANCE OF NOT TO EXCEED $1,000,000 GENERAL OBLIGATION URBAN RENEWAL BONDS. WHEREAS,by Resolution No. 1990-644, adopted November 19, 1990, and Resolution 2004-372, adopted June 14, 2004, and Resolution No. 2009-633, dated July 6, 2009, and amended by Resolution No 2016-146, adopted March 7, 2016 the Council found and determined that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa law, and approved and adopted the Rath Area Redevelopment Plan for the Rath Tax Increment Redevelopment Area described therein, which Plan, as amended, is on file in the office of the Recorder of Black Hawk County; and WHEREAS,by Ordinance No. 2723, adopted on December 23, 1974, amended by Resolution No. 1996-804, adopted December 16, 1996, amended by Resolution No 2001-394, adopted August 6, 2001, amended by Resolution No. 2003-225, adopted April 7, 2003, amended by Resolution No. 2011-1109, adopted December 5, 2011, amended by Resolution No. 2014- 966, adopted November 10, 2014, and amended by the Resolution No. 2015-632, adopted August 10,2015 the Council found and determined that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa law, and approved and adopted the Downtown Waterloo Riverfront Urban Renewal and Redevelopment Area Plan for the Downtown Waterloo Riverfront Urban Renewal and Redevelopment Area described therein, which Plan, as amended, is on file in the office of the Recorder of Black Hawk County; and WHEREAS, by Resolution No. 1996-673, adopted October 6, 1996, and Resolution 2004-522, adopted ted Au st 9 2004 amended - p August d by Resolution No. 2014 903, adopted October 20, 2014, and amended by Resolution No. 2016-197, adopted March 21, 2016 the Council found and determined that certain areas located within the City axe-eligible and should be designated as an urban renewal area under Iowa law, and approved and adopted the Martin Road Industrial Development Plan(the "Plan") for the Martin Road Development Area(the "Area" or "Urban Renewal Area"), which Plan is on file in the office of the Recorder of Black Hawk County, Iowa; and WHEREAS,the City of Waterloo, State of Iowa, is in need of funds to carry out the purpose of providing funds to pay the costs of aiding in the planning, undertaking and carrying out of urban renewal projects under the authority of Chapter 403 and the Urban Renewal Plans for the Downtown Waterloo Riverfront Urban Renewal and Redevelopment Area,the Martin Road Development Plan, and the Rath Area Redevelopment Plan, such as those costs associated with land acquisitions,public infrastructure projects including streets, streetscape, and utility improvements,the downtown development plan, downtown acquisitions, and demolition costs; and WHEREAS, it is deemed necessary and advisable that the City of Waterloo, State of Iowa, should issue General Obligation Urban Renewal Bonds,to the amount of not to exceed $1,000,000, as authorized by Section, of the Code of Iowa, for the purpose of providing funds to pay costs of carrying out essential corporate urban renewal purpose project(s); and WHEREAS, before the Bonds may be issued, it is necessary to comply with the provisions of Chapter 384 and 403 of the Code of Iowa, and to publish a notice of the proposal to issue such Bonds to receive oral and/or written objections from any resident or property owner to Resolution No. 2016-376 Page 2 such action, and the right to petition for an election; and WHEREAS,the notice of above meeting has been published as required by Section of the Code of Iowa, as amended, and the following action is now considered to be in the best interests of the City and its residents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, STATE OF IOWA: Section 1. That the action of the Clerk setting a public hearing before the City Council to meet in the Council Chambers, City Hall, 715 Mulberry Street, Waterloo, Iowa, at 5:30 P.M., the 23rd day of May, 2016, for the purpose of taking action on the matter of the issuance of not to exceed$1,000,000 General Obligation Urban Renewal Bonds, for essential corporate urban renewal purpose project(s),the proceeds of which will be used to provide funds to pay the costs of aiding in the planning, undertaking and carrying out of urban renewal projects under the authority of Chapter 403 and the Urban Renewal Plans for the Downtown Waterloo Riverfront Urban Renewal and Redevelopment Area,the Martin Road Development Plan, and the Rath Area Redevelopment Plan, such as those costs associated with land acquisitions, public infrastructure projects including streets, streetscape, and utility improvements, the downtown development plan, downtown acquisitions, and demolition costs, is hereby ratified, confirmed and approved. Section 2. That the Clerk has caused publication to be made of a notice of said meeting, in a legal newspaper, printed wholly in the English language, published at least once weekly, and having general circulation in the City, said publication to be not less than ten (10) nor more than twenty(20) clear days before the date of the public meeting on the issuance of the Bonds. Section 3. That the form of notice of public hearing is hereby ratified, confirmed and approved. PASSED AND ADOPTED this 23rd day of May, 2016. NOTICE MUST BE GIVEN PURSUANT TO IOWA CODE CHAPTER 21 AND THE LOCAL RULES OF THE CITY. Resolution No. 2016-376 May 23, 2016 The City Council of the City of Waterloo, State of Iowa, met in regular session, in the Council Chambers, City Hall, 715 Mulberry Street, Waterloo, Iowa, at 5:30 P.M., on the above date. There were present Mayor Quentin M. Hart, in the chair, and the following named Council Members: Jacobs, Morrissey, Lind, Amos, Schmitt, and Welper Absent: None. Vacant: One. Resolution No. 2016-376 Council Member Welper introduced the following Resolution entitled "RESOLUTION RATIFYING, CONFIRMING AND APPROVING PUBLICATION OF NOTICE OF PUBLIC HEARING FOR THE ISSUANCE OF NOT TO EXCEED $1,000,000 GENERAL OBLIGATION URBAN RENEWAL BONDS", and moved that the same be adopted. Council Member Morrissey seconded the motion to adopt. The roll was called and the vote was, AYES: Six. NAYS: None.
