Motion carried. Discussion of the FY2024 audit. Bridgett wood introduced Dustin Opatz, BergenKDV, who will be giving a presentation on the FY24 audit results. Mayor Hart and Council Members discussed the audit with Mr. Opatz. Discussion of a Park Avenue Bridge memorial installation. Wayne Castle, Assistant City Engineer, introduced Dan Fullerton, Stanley Consultants and Mark Kuiper, Ritland+Kuiper who will be sharing about the Park Avenue Bridge Historical Marker. Wayne Castle provided historical background on the Park Avenue Bridge and how this project developed to where we are today. Dan Fullerton shared that Stanley Consultants is the consulting engineering firm working with Invision Architecture and Ritland+Kuiper. He shared a presentation on the project details. Construction is anticipated to be completed in Late Fall 2025 with a construction cost estimate of $172,000.00. Mark Kuiper, Ritland+Kuiper, shared conceptual images and noted that the design of the plaza is very similar to all of the overlooks that were done on the River Renaissance project. Multi Space Parking Meter: Also referred to as "pay station," "pay -and -display meter," or "kiosk," is a Meter that manages multiple parking spaces within a designated area and collect fees. Parking Zone: Any group of parking spaces designated as a parking zone by the city where certain parking regulations apply and is delineated from other parking areas; there could be several parking zones. Parking Fees: Cost of parking due to the city for parking a vehicle in a parking space as per City parking ordinances and cost requirements. Time Limit: Also referred to as Parking Interval or Parking Duration: The allowable time during which a driver may utilize a parking space to park a vehicle by paying the required parking Fees. Maximum Time or Maximum Time Limit: The maximum allowable parking duration in a particular space beyond which time parking is prohibited. Paid Parking: A system where fees are required for the use of designated parking spaces, collected via Parking Meters, mobile apps, attendants, or other methods. Cash Payment: Any method of paying for a one-time use of Paid Parking space such as legal currency or allowed electronic payment methods. Subscription: Paying a recurring fee such as monthly, quarterly, or annually to secure access to a designated parking spot or facility. Parking Ramp: off-street multi -story parking facility SEC. 320. DESIGNATION OF PAID PARKING AREAS. The City of Waterloo is hereby authorized and directed to designate and mark off individual parking spaces on streets and within designated parking lots as conditions permit and shall install Parking Meters providing parking time limits within the downtown area bound by Walnut Street, Seventh Street, South Street and Westfield Avenue. The location of the metered parking spaces and the type of meters installed providing parking time limits shall be designated by Resolution of the City Council. (Ord. #3591, 10/24/88; '91 Rev.) SEC. 321. REGULATION OF PARKING IN INDIVIDUAL SPACES. Page 4 of 114 Whenever a vehicle is parked in a designated Paid Parking space, the person parking such vehicle shall pay as designated on the Parking Meter or signs if such Meter displays the signal showing that legal parking is only permitted upon such a payment. It is hereby established that the Parking Fees and parking Time Limit allowed for such fees for parking within individual Paid Parking spaces shall be by Resolution of the City Council. Notice to the public shall be given by appropriate signs setting forth the length of time for which parking is permitted and the conditions thereof. These may be upon the face of the Parking Meter, on the Parking Meter stand or in the immediate vicinity. Any vehicle which remains in an individual Paid Parking space after the prescribed time for parking is hereby determined to be illegally parked. The provisions of this ordinance shall not apply to vehicles parked or standing in the areas hereinbefore designated between the hours of 8:00 p.m. and 9:00 a.m. Monday through Friday. The provisions of this ordinance shall not apply on Legal Holidays. SEC. 322. FEES FOR SUBSCRIPTION RAMP AND LOT PARKING. (Ord. #3324, 2/6/84; repealed by Ord. #3591, 10/24/88) SEC. 323. EVIDENCE.323. Existence of a vehicle parked in any parking space designated as Paid Parking without making the required payment shall be deemed prima facie evidence of the unlawful parking of such vehicle by its operator. SEC. 324. OVERTIME PARKING. It shall be unlawful and a violation of the provisions of this Article for any person to cause, allow, permit, or suffer any vehicle registered in the name of, or operated by, such person to be parked overtime or beyond the period of legal parking time established for any Parking Meter zone as herein described. SEC. 325. EXCEEDING MAXIMUM TIME VIOLATION. It shall be illegal to park beyond the Maximum Time and each successive Parking Interval is a new violation regardless of payment status. (Ord. #3591, 10/24/88) SEC. 326. RESERVED SPACE. Page 5 of 114 It shall be unlawful and a violation of the provisions of this Article for any person to cause, allow, permit, or suffer any vehicle registered in the name of or operated by such person to be parked in an individual parking space reserved for another as provided in Section 311. (Ord. #3591, 10/24/88) SEC. 327. DEFACE PARKING METER. It shall be unlawful and a violation of the provisions of this Article for any person to deface, injure, tamper with, open or willfully break, destroy, or impair the usefulness of any Parking Meter installed by the city. SEC. 328. SLUGS NOT TO BE USED. It shall be unlawful and a violation of the provisions of this article to deposit or cause to be deposited in any parking meter, any slug, device, or metallic substance, or any other substitute for a coin of the United States. SEC. 329. INFORMATION ON TICKETS. It shall be the duty of all personnel authorized to enforce parking regulations to report: (a) The number of each single space Parking Meter which indicates that the vehicle occupying the parking space adjacent to such parking meter, or reference to the Multi Space Meter controlling the Parking Zone, is or has been parking in violation of the Traffic Code; (b) The state license number of such vehicle; (c) The time of day which the violation occurred; (d) Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation; the authorized personnel shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has been parking in violation of this Traffic Code and instructing such owner or operator on payment or appeal procedures. (Ord. #3324, 2/6/84; Ord. #3591, 10/24/88; Ord. #3744, 9/24/90) SEC.330. PENALTY. Any person who shall violate any of the provisions of either Section 324, 325, 326, 327 or 328 and any person who aids, abets, or assists therein, shall be guilty of a simple misdemeanor and upon conviction thereof, shall be punished accordingly. Page 6 of 114 SEC. 331. BOND FOR MONEY COLLECTORS. The City Treasurer or a city employee designated by the Treasurer shall collect all coins deposited in the Parking Meters. Such employee, except for temporary help, shall furnish a bond in the amount of five thousand dollars ($5,000.00) with surety approved by the City Council. All funds collected from Parking Meters shall be credited to the Parking Meter Fund ('91 Rev.). SEC. 332. FREE SPACES ALLOWED. Any authority heretofore or hereafter exercised by the City of Waterloo, Iowa, under any ordinance, rule or regulation restricting or prohibiting parking, independent of time limits, shall in no manner be affected by these sections pertaining to Parking Meters or any of the provisions thereof. The purpose of this article is to assist in the regulation of overtime parking by the use of Parking Meters, and it shall be so construed. Nothing in this section shall be construed as prohibiting the City of Waterloo, Iowa, from providing for free parking space for loading and unloading, for taxicab stands, special events, and for other matters of similar nature. SEC. 333. APPLICATION OF REVENUE (Repealed by Ord. #3591, 10/24/88) Revenues from Paid Parking system including violation fees shall be used for ???? the operation, maintenance, and enhancements of parking systems and facilities and traffic safety improvements????? SEC. 335. PARKING FINES. (a) PARKING WITHOUT PAYMENT: It shall be a violation of this article for any person to permit a vehicle to park in any parking designated as Paid Parking space during permitted Paid Parking times without making the required payments. Legal parking is only permitted upon such a payment. This type of violation shall be designated as a meter violation. A fine for each violation of this subsection shall be: $??.00 if paid within 30 days $??.00 if paid after 30 days. (b) PARKING BEYOND MAXIMUM TIME: It shall be a violation of this article for any person to permit a vehicle to park in any parking designated as a Paid Parking space beyond the maximum period of legal parking time established for any designated Paid Parking zone. This type of violation shall be designated as overtime parking. A fine for each violation of this subsection shall be: Page 7 of 114 $??.00 if paid within 30 days $??.00 if paid after 30 days. (c) It shall be a violation of this article for any person to permit a vehicle to park in any parking space which is in violation of any of the following subsections and shall be classified as an improper, restricted or prohibited parking violation. A fine for each violation of this subsection shall be: $15.00 if paid within 30 days $20.00 if paid after 30 days. Improper, restricted or prohibited parking violation shall be as follows: SEC. 273. PARKING RAMPS SEC. 341. REGULATION OF PARKING OF CASH PATRONS. (a) Mechanical Devices The City of Waterloo is hereby authorized and directed to establish at the entrance and exit to parking ramps, when applicable, appropriate mechanical devices to regulate the entrance and exit of cash patrons using the parking facility. The mechanical devices regulating entrance in the parking facility shall provide for the entrance of one vehicle at a time, provided the operator of the vehicle entering accepts a parking ticket noting time of entrance. At the cash patron's exit from the parking facility there shall be maintained a facility where cash patrons shall pay for the use of the parking facility at the rates hereinafter set forth in this article. ('91 Rev.) (b) Parking Meters The City of Waterloo is hereby authorized and directed to install Parking Meters on parking ramps, when the city deems it to be appropriate for operations where mechanical gates will or will not be needed. SEC. 342. REGULATION OF PARKING OF SUBSCRIPTION PARKERS. (a) Mechanical Devices The City of Waterloo is hereby authorized and directed to establish at the entrance and exit to the parking ramp appropriate mechanical devices to regulate the entrance and exit of subscription parkers using the parking facility. The mechanical and/or electronic devices regulating entrance in the parking facility shall provide for the entrance of one vehicle at a Page 9 of 114 time, provided the subscription parker provides appropriate identification or proof as a subscription parker. ('91 Rev.) (b) Parking Meters The City of Waterloo is hereby authorized to issue electronic or other forms of permits for subscription parkers at ramps where control is established by gates, Parking Meters, or both. SEC. 343. PARKING RATES FOR CASH PATRONS. It is hereby established that the fees for cash patrons for all parking ramps shall be set by Resolution of the City Council. (Ord. #3324, 2/6/84; Ord. #3402, 8/19/85; Ord. #3416, 12/2/85; Ord. #5000, 7/19/10) SEC. 344. SUBSCRIPTION PARKING. Subscription parkers shall be authorized to use parking facilities upon payment of the required fee as designated by City Council. (Ord. #4002, 1/18/94) SEC. 345. OBTAIN PARKING STUB It shall be unlawful and a violation of the provisions of this article for any person to cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such person entering a gated parking facility where obtaining a paper parking stub is the only form of available parking control without first obtaining a parking stub at the entrance gate. SEC. 346. EXIT WITHOUT PAYING. It shall be unlawful and a violation of the provisions of this article for any persons to cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such persons to exit the parking facility without having paid the required fee for use of the parking facility. SEC. 347. VANDALISM OF MECHANICAL AND ELCTRONIC DEVICES. It shall be unlawful and a violation of the provisions of this article to deface, hack into, injure, tamper with, open or willfully break, destroy, impair the usefulness or impair intended operation of any mechanical or electronic devices installed under the provisions of this article. Page 10 of 114 SEC. 348. ENTER RAMP OTHER THAN ENTRANCE. It shall be unlawful and a violation of the provisions of this article for any persons to cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such persons to attempt to enter a parking ramp in any other manner than provided, for entrance of motor vehicles. SEC. 349. PAY SUBSCRIPTION FEE. It shall be unlawful and a violation of this article under the provisions of this article for any persons to cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such persons to enter through the subscription parker's entrance unless the operator or owner of the vehicle has paid the appropriate subscription parking fee. SEC. 350. PENALTY.350. Any person who shall violate any of the provisions of this article and any person who aids, abets, or assists therein shall be guilty of a simple misdemeanor and upon conviction thereof shall be punished accordingly. SEC. 351. APPLICATION OF REVENUE. (Repealed by Ord. #3591, 10/24/88) SEC. 352. CITY PARKING LOTS.352. (a) That the City Council is hereby authorized to establish parking areas known as City Hall Lot adjacent to City Hall and City Hall Annex Lot adjacent to City Hall Annex. (Ord. #3360, 8/20/84) (b) The above parking areas shall be used strictly by city personnel. (c) Each vehicle parking in one of the above lots shall have a sticker issued by the City of Waterloo designating an assigned parking space. (d) Any stickered vehicle parking in a space not designated for that vehicle shall be considered in violation and will be subject to fines established by council resolution. (Ord. #4002, 1/18/94) (e) Any non-stickered vehicle parking in one of the lots under this ordinance shall be subject to a fines established by council resolution, and the city shall have authority to tow such non-stickered vehicle at the owner's expense. Any a vehicle parked in contravention of this provision shall be deemed to be illegally parking under thc provisions signal on thc parking meter or the same shows no parking permitted, unless a deposit of a proper coin is made as hcrcin providcdany parking space designated as Paid Parking without making the required payment shall be deemed prima facie evidence of the unlawful parking of such motor vehicle by its operator. SEC. 324. OVERTIME PARKING.32 1. OVERTIME PARKING. Page 14 of 114 It shall be unlawful and a violation of the provisions of this Article for any person to cause, allow, permit, or suffer any vehicle registered in the name of, or operated by, such person to be parked overtime or beyond the period of legal parking time established for any parking mctcrParking Meter zone as herein described. SEC. 325. SUCCESSIVE INTERVAL NEWEXCEEDING MAXIMUM TIME VIOLATION.325. SUCCESSIVE INTERVAL NEW VIOLATION. It shall be unlawful and a violation of the provisions of this Article for any personillegal to permit a vehicle to remain in any parking place adjacent to any parking meter while said meter is displaying a signal indicating that thc vehicle occupying such parking space has already bccn parkcdpark beyond the period of time prescribed for such parking space. Even though money has bccn put into thc meter, parking for a period of time over thc time allowed on the meter will be a violation. EachMaximum Time and each successive intervalParking Interval is a new violation,- regardless of payment status. (Ord. #3591, 10/24/88) SEC. 326. RESERVED SPACE.326. RESERVED SPACE. It shall be unlawful and a violation of the provisions of this Article for any person to cause, allow, permit, or suffer any vehicle registered in the name of or operated by such person to be parked in an individual parking space reserved for another as provided in Section 311. (a) Mechanical Devices The City of Waterloo is hereby authorized and directed to establish at the entrance and exit to the parking rampramps, when applicable, appropriate mechanical devices to regulate the entrance and exit of cash patrons using the parking facility. The mechanical devices regulating entrance in the parking facility shall provide for the entrance of one vehicle at a time, provided the operator of the vehicle entering accepts a parking ticket noting time of entrance. At the cash patron's exit from the parking facility there shall be maintained a cashier facility where cash patrons shall pay for the use of the parking facility at the rates hereinafter set forth in this article. (b) Parking Meters The City of Waterloo is hereby authorized and directed to install Parking Meters on parking ramps, when the city deems it to be appropriate for operations where mechanical gates will or will not be needed. SEC. 347. DEFACEVANDALISM OF MECHANICAL AND ELCTRONIC DEVICES.31 7. DEFACE MECHANICAL DEVICES. It shall be unlawful and a violation of the provisions of this article to deface, hack into, injure, tamper with, open or wilfullywillfully break, destroy, impair the usefulness or impair intended operation of any mechanical or electronic devices installed under the provisions of this article. SEC. 348. ENTER RAMP OTHER THAN ENTRANCE.318. ENTER RAMP OTHER THAN ENTRANCE. Page 20 of 114 It shall be unlawful and a violation of the provisions of this article for any persons to cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such persons to attempt to enter a parking ramp in any other manner than provided, for entrance of motor vehicles. SEC. 349. PAY MONTHLY FEE.349. PAY MONTHLYPAY SUBSCRIPTION FEE. It shall be unlawful and a violation of this article under the provisions of this article for any persons to cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such persons to enter through the menthlysubscription parker's entrance unless the operator or owner of the vehicle has paid the appropriate monthlysubscription parking fee. SEC.350. PENALTY.350. PENALTY. Any person who shall violate any of the provisions of this article and any person who aids, abets, or assists therein shall be guilty of a simple misdemeanor and upon conviction thereof shall be punished accordingly. The City of Waterloo is hereby authorized and directed to designate and mark off metered individual parking spaces on streets and within designated parking lots as conditions permit and shall install meters providing parking time limits within the downtown area bound by Walnut Street, Seventh Street, South Street and Westfield Avenue. The location of the metered individual parking spaces and the type of meters installed providing parking time limits shall be designated by Resolution of the City Council. Whenever a vehicle shall be parked in an individual parking space where a parking meter has been installed, the person parking such vehicle shall deposit in said parking meter, coins of United States money in denominations as designated on the meter if such meter displays the signal showing that legal parking is only permitted upon such a deposit. It is hereby established that the fees and parking time allowed for such fees for parking within individual parking spaces where the same have been designated, and a parking meter installed, shall be by Resolution of the City Council. Notice to the public shall be given by appropriate signs setting forth the length of time for which parking is permitted and the conditions thereof. These may be upon the face of the parking meter, on the parking meter stand or in the immediate vicinity. Any vehicle which remains in an individual parking space after the prescribed time for parking is hereby determined to be illegally parked. The provisions of this ordinance shall not apply to vehicles parked or standing in the areas hereinbefore designated between the hours of 6:00 p.m. and 9:00 a.m. of each week day except Monday, when the provisions of this ordinance shall apply until 9:00 p.m. The provisions of this ordinance shall not apply on Sundays and Legal Holidays. Any vehicle parked in contravention of this provision shall be deemed to be illegally parking under the provisions of this ordinance. The fact that a vehicle is in an individual parking space when the time signal on the parking meter or the same shows no parking permitted, unless a deposit of a proper coin is made as herein provided shall be deemed prima facie evidence of the unlawful parking of such motor vehicle by its operator. SEC. 324. OVERTIME PARKING.324. OVERTIME PARKING. It shall be unlawful and a violation of the provisions of this Article for any person to cause, allow, permit, or suffer any vehicle registered in the name of, or operated by, such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as herein described. SEC. 325. SUCCESSIVE INTERVAL NEW VIOLATION.325. SUCCESSIVE INTERVAL NEW VIOLATION. It shall be unlawful and a violation of the provisions of this Article for any person to permit a vehicle to remain in any parking place adjacent to any parking meter while said meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period of time prescribed for such parking space. Even though money has been put into the meter, parking for a period of time over the time allowed on the meter will be a violation. Each successive interval is a new violation. (Ord. #3591, 10/24/88) SEC. 326. RESERVED SPACE.326. RESERVED SPACE. It shall be unlawful and a violation of the provisions of this Article for any person to cause, allow, permit, or suffer any vehicle registered in the name of or operated by such person to be parked in an individual parking space reserved for another as provided in Section 311. It shall be unlawful and a violation of the provisions of this article to deposit or cause to be deposited in any parking meter, any slug, device, or metallic substance, or any other substitute for a twenty -five -cent coin, ten -cent coin, five -cent coin, or one -cent coin of the United States. SEC. 329. INFORMATION ON TICKETS.329. INFORMATION ON TICKETS. It shall be the duty of all personnel authorized to enforce parking regulations to report: (a) The number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is or has been parking in violation of the Traffic Code; (b) The state license number of such vehicle; (c) The time of day which the violation occurred; (d) Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation; the authorized personnel shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has been parking in violation of this Traffic Code and instructing such owner or operator on payment or appeal procedures. ALLOW INGRESS AND EGRESS.358. ALLOW INGRESS AND EGRESS. When signs are erected giving notice thereof, no person shall park any vehicle at any time upon the streets providing ingress and egress to the Waterloo Municipal Airport Facilities from Airline Highway, except as provided in Section 359. Page 30 of 114 SEC. 359. PARKING REGULATIONS AT AIRPORT.359. TEN MINUTE PARKING. When signs are erected giving notice thereof, the following parking regulations shall apply on the street in front of the main airport terminal at the Waterloo Municipal Airport: (a) No parking along the south side of the road. This lane shall remain a through lane. (b) The north side of the road, which is the closest to the main airport terminal, shall be a drop-off zone only. Under no circumstances may a vehicle be left unattended in the drop- off zone. Unattended means that the driver of the vehicle shall, at all times, be in or around the vehicle, may not exit the vehicle other than to drop off persons and/or baggage at the drop-off zone, and thereafter shall immediately move the vehicle from the drop-off zone. (c) Any vehicle left unattended in the drop-off zone shall be subject to a fine and the vehicle(s) may be immediately towed at the owner's sole expense. (d) Only the following persons shall be authorized to enforce this section: police officers of the Waterloo Police Department, Waterloo Fire Rescue personnel assigned to the Waterloo Municipal Airport, security personnel employed by the Waterloo Airport Board, the Airport Director, and the Assistant Airport Director. (e) A violation of this section shall be a municipal infraction and punishable by a fine of not less than nor more than One Hundred Dollars ($100.00). (Ord. #4373, 7/19/99; Ord. #4440, 10/2/00; Ord. #4522, 10/22/01) SEC. 360. PERSONS AUTHORIZED TO ENFORCE PARKING REGULATIONS AT AIRPORT.360. PERSONS AUTHORIZED TO ISSUE TICKETS AT AIRPORT. With the exception of Section 359, the following persons are authorized to enforce the parking regulations at the Airport. The Airport Director, Assistant Airport Director, Waterloo Fire Rescue personnel assigned to the Airport, skycaps, janitorial service personnel, and maintenance personnel employed by the Airport Commission, and police officers of the Waterloo Police Department are hereby authorized to enforce parking regulations as set out in Section 358. They shall also be authorized to issue handicapped parking tickets, but only at the Waterloo Municipal Airport. The fine for parking violations at the Waterloo Municipal Airport shall be Five Dollars ($5.00). Multi Space Parking Meter: Also referred to as "pay station," "pay -and -display meter," or "kiosk," is a Meter that manages multiple parking spaces within a designated area and collect fees. Parking Zone: Any group of parking spaces designated as a parking zone by the city where certain parking regulations apply and is delineated from other parking areas; there could be several parking zones. Parking Fees: Cost of parking due to the city for parking a vehicle in a parking space as per City parking ordinances and cost requirements. Time Limit: Also referred to as Parking Interval or Parking Duration: The allowable time during which a driver may utilize a parking space to park a vehicle by paying the required parking Fees. Maximum Time or Maximum Time Limit: The maximum allowable parking duration in a particular space beyond which time parking is prohibited. Paid Parking: A system where fees are required for the use of designated parking spaces, collected via Parking Meters, mobile apps, attendants, or other methods. Cash Payment: Any method of paying for a one-time use of Paid Parking space such as legal currency or allowed electronic payment methods. Subscription: Paying a recurring fee such as monthly, quarterly, or annually to secure access to a designated parking spot or facility. Parking Ramp: off-street multi -story parking facility SEC. 320. DESIGNATION OF TWELVE MINUTE, THIRTY MINUTE, ONE HOUR, TWO HOUR, FOUR HOUR AND TEN HOURPAID PARKING METER AREAS.320. The City of Waterloo is hereby authorized and directed to designate and mark off metered individual parking spaces on streets and within designated parking lots as conditions permit and shall install mctcrsParking Meters providing parking time limits within the downtown area bound by Walnut Street, Seventh Street, South Street and Westfield Avenue. The location of the metered individual parking spaces and the type of meters installed providing parking time limits shall be designated by Resolution of the City Council. It is hereby established that the feesParking Fees and parking timeTime Limit allowed for such fees for parking within individual parkingPaid Parking spaces where thc same have bccn designated, and a parking meter installed, shall be by Resolution of the City Council. Notice to the public shall be given by appropriate signs setting forth the length of time for which parking is permitted and the conditions thereof. These may be upon the face of the parking meterParking Meter, on the parking meterParking Meter stand or in the immediate vicinity. Any vehicle which remains in an individual parkingPaid Parking space after the prescribed time for parking is hereby determined to be illegally parked. The provisions of this ordinance shall not apply to vehicles parked or standing in the areas hereinbefore designated between the hours of 48:00 p.m. and 9:00 a.m. of each week day except Monday, when the provisions of this ordinance shall apply until 9:00 p.m. through Friday. Any a vehicle parked in contravention of this provision shall be deemed to be illegally parking under thc provisions signal on thc parking meter or the same shows no parking permitted, unless a deposit of a proper coin is made as hcrcin providcdany parking space designated as Paid Parking without making the required payment shall be deemed prima facie evidence of the unlawful parking of such motor vehicle by its operator. SEC. 324. OVERTIME PARKING.32 1. OVERTIME PARKING. Page 46 of 114 It shall be unlawful and a violation of the provisions of this Article for any person to cause, allow, permit, or suffer any vehicle registered in the name of, or operated by, such person to be parked overtime or beyond the period of legal parking time established for any parking mctcrParking Meter zone as herein described. SEC. 325. SUCCESSIVE INTERVAL NEWEXCEEDING MAXIMUM TIME VIOLATION.325. SUCCESSIVE INTERVAL NEW VIOLATION. It shall be unlawful and a violation of the provisions of this Article for any personillegal to permit a vehicle to remain in any parking place adjacent to any parking meter while said meter is displaying a signal indicating that thc vehicle occupying such parking space has already bccn parkcdpark beyond the period of time prescribed for such parking space. Even though money has bccn put into thc meter, parking for a period of time over thc time allowed on the meter will be a violation. EachMaximum Time and each successive intervalParking Interval is a new violation,- regardless of payment status. (Ord. #3591, 10/24/88) SEC. 326. RESERVED SPACE.326. RESERVED SPACE. It shall be unlawful and a violation of the provisions of this Article for any person to cause, allow, permit, or suffer any vehicle registered in the name of or operated by such person to be parked in an individual parking space reserved for another as provided in Section 311. (Ord. #3591, 10/24/88) SEC. 327. DEFACE PARKING METER.327. DEFACE PARKING METER. It shall be unlawful and a violation of the provisions of this Article for any person to deface, injure, tamper with, open or willfully break, destroy, or impair the usefulness of any parking mctcrParking Meter installed undcrby the provisions of this ordinancecity. SEC. 328. SLUGS NOT TO BE USED.328. SLUGS NOT TO BE USED. It shall be unlawful and a violation of the provisions of this article to deposit or cause to be deposited in any parking meter, any slug, device, or metallic substance, or any other substitute for a twenty five cent coin, ten cent coin, five cent coin, or one cent coin of the United States. SEC. 329. INFORMATION ON TICKETS.329. INFORMATION ON TICKETS. It shall be the duty of all personnel authorized to enforce parking regulations to report: Page 47 of 114 (a) The number of each parking metersingle space Parking Meter which indicates that the vehicle occupying the parking space adjacent to such parking meter, or reference to the Multi Space Meter controlling the Parking Zone, is or has been parking in violation of the Traffic Code; (b) The state license number of such vehicle; (c) The time of day which the violation occurred; (d) Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation; the authorized personnel shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has been parking in violation of this Traffic Code and instructing such owner or operator on payment or appeal procedures. Any person who shall violate any of the provisions of either Section 324, 325, 326, 327 or 328 and any person who aids, abets, or assists therein, shall be guilty of a simple misdemeanor and upon conviction thereof, shall be punished accordingly. SEC. 331. BOND FOR MONEY COLLECTORS.331. BOND FOR MONEY COLLECTORS. The City Treasurer or a city employee designated by the Treasurer shall collect all coins deposited in the parking metersParking Meters. Such employee, except for temporary help, shall furnish a bond in the amount of five thousand dollars ($5,000.00) with surety approved by the City Council. All funds collected from parking metersParking Meters shall be credited to the Parking Meter Fund.- ('91 Rev3j. SEC. 332. FREE SPACES ALLOWED.332. FREE SPACES ALLOWED. Any authority heretofore or hereafter exercised by the City of Waterloo, Iowa, under any ordinance, rule or regulation restricting or prohibiting parking, independent of time limits, shall in no manner be affected by these sections pertaining to parking mctcrsParking Meters or any of the provisions thereof. The purpose of this article is to assist in the regulation of overtime parking by the use of parking metersParking Meters, and it shall be so construed. Nothing in this section shall be construed as prohibiting the City of Waterloo, Iowa, from providing for free parking space for loading and unloading, for taxicab stands, special events, and for other matters of similar nature. (a) Mechanical Devices The City of Waterloo is hereby authorized and directed to establish at the entrance and exit to the parking rampramps, when applicable, appropriate mechanical devices to regulate the entrance and exit of cash patrons using the parking facility. The mechanical devices regulating entrance in the parking facility shall provide for the entrance of one vehicle at a time, provided the operator of the vehicle entering accepts a parking ticket noting time of entrance. At the cash patron's exit from the parking facility there shall be maintained a cashier facility where cash patrons shall pay for the use of the parking facility at the rates hereinafter set forth in this article. (b) Parking Meters The City of Waterloo is hereby authorized and directed to install Parking Meters on parking ramps, when the city deems it to be appropriate for operations where mechanical gates will or will not be needed. SEC. 342. REGULATION OF PARKING OF MONTHLYSUBSCRIPTION PARKERS.342. REGULATION OF PARKING OF MONTHLY PARKERS. (a) Mechanical Devices The City of Waterloo is hereby authorized and directed to establish at the entrance and exit to the parking ramp appropriate mechanical devices to regulate the entrance and exit of monthlysubscription parkers using the parking facility. The mechanical and/or electronic devices regulating entrance in the parking facility shall provide for the entrance of one vehicle at a time, provided the monthlysubscription parker provides appropriate identification or proof as a monthlysubscription parker. It shall be unlawful and a violation of the provisions of this article for any persons to cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such persons to exit the parking facility without first payinghaving paid the required fee for use of the parking facility. SEC. 347. DEFACEVANDALISM OF MECHANICAL AND ELCTRONIC DEVICES.31 7. DEFACE MECHANICAL DEVICES. It shall be unlawful and a violation of the provisions of this article to deface, hack into, injure, tamper with, open or wilfullywillfully break, destroy, impair the usefulness or impair intended operation of any mechanical or electronic devices installed under the provisions of this article. SEC. 348. ENTER RAMP OTHER THAN ENTRANCE.318. ENTER RAMP OTHER THAN ENTRANCE. Page 52 of 114 It shall be unlawful and a violation of the provisions of this article for any persons to cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such persons to attempt to enter a parking ramp in any other manner than provided, for entrance of motor vehicles. It shall be unlawful and a violation of this article under the provisions of this article for any persons to cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such persons to enter through the menthlysubscription parker's entrance unless the operator or owner of the vehicle has paid the appropriate monthlysubscription parking fee. Fees shall be paid when the application is submittedby March 31 or within nincty (90) days after thc date on which any dog or cat that is not licensed first becomes subject to licensure under subsection B of this section. Any fee not paid by thc due date shall increase to an amount determined from time to time by resolution of the city council. 2. Duplicate licenses shall be issued at a cost determined from time to time by resolution of the city council. 3. The city license fee shall be waived for all dogs or cats if thc owner of said dogs or cats has a valid license issued by the state of Iowa that allows the keeping of such animals. 34. The owner of all dogs or cats six (6) months old or older must comply with all the provisions of this article, including, but not limited to, the obtaining of rabies vaccination and license tag, even if the license fee has been waived. A written certificate from a licensed veterinarian shall be required to prove that a dog or cat is incapable of breeding and has been vaccinated for rabies. E. Term Of License: All licenses shall expire on January 1 of the one year following the date of issuance, and a license tag issued for one dog or cat shall not be transferable to another dog or cat. Transfer Or Change Of Ownership: When the permanent ownership of a dog or cat is transferred, the license for the same may be transferred by the police department city clerk by the notation on the license record giving name and address of the new owner. Implied Consent: The application for and the receipt of a license as required herein shall include an implied consent by the owner to permit an inspection of both real and personal property under his control for the purpose of carrying out the provisions of this article, including inspection for cruelty to animals or an inspection of sanitary conditions. Type Of Vaccine: The rabies vaccination required by subsection A of this section shall be an injection of anti -rabies vaccine approved by the Iowa state department of agriculture, and the frequency of revaccination necessary for approved vaccination shall be as established by subject department. The vaccine shall be administered by a licensed veterinarian and shall be given as approved by the Iowa state department of agriculture. Evidence of said rabies vaccination shall be a certificate of vaccination signed by a licensed veterinarian, and the certificate shall show that the vaccination does not expire within six (6) months from the effective date of the dog or cat license. Such application or license may be made after the expiration of any current licenseJanuary 1, and within thirty (30) days after at any time, for a dog or cat which has comes into the possession or ownership of the applicant, or which has reached the age of six (6) months after said date. C. Form Of Application: Subject Aapplications shall be in a form writing on blanks provided by the police department , or it's designee city clerk, and shall state the breed, sex, age, color, markings and name, if any, of the dog or cat, and the address of the owner and be signed by said owner. Such application shall also state the date of the most recent rabies vaccination, the type of vaccine administered and the date the dog or cat shall be revaccinated. D. License Fees: 1. The annual license fee for each dog or cat shall be determined from time to time by resolution of the city council. Fees shall be paid when the application is submittedby March 31 or within nincty (90) days after thc date on which any dog or cat that is not licensed first becomes subject to licensure under subsection B of this section. Any fee not paid by thc due date shall increase to an amount determined from time to time by resolution of the city council. 2. Duplicate licenses shall be issued at a cost determined from time to time by resolution of the city council. 3. The city license fee shall be waived for all dogs or cats if thc owner of said dogs or cats has a valid license issued by the state of Iowa that allows the keeping of such animals. 34. The owner of all dogs or cats six (6) months old or older must comply with all the provisions of this article, including, but not limited to, the obtaining of rabies vaccination and license tag, even if the license fee has been waived. A written certificate from a licensed veterinarian shall be required to prove that a dog or cat is incapable of breeding and has been vaccinated for rabies. E. Term Of License: All licenses shall expire on January 1 of the one year following the date of issuance, and a license tag issued for one dog or cat shall not be transferable to another dog or cat. Transfer Or Change Of Ownership: When the permanent ownership of a dog or cat is transferred, the license for the same may be transferred by the police department city clerk by the notation on the license record giving name and address of the new owner. G. Implied Consent: The application for and the receipt of a license as required herein shall include an implied consent by the owner to permit an inspection of both real and personal property under his control for the purpose of carrying out the provisions of this article, including inspection for cruelty to animals or an inspection of sanitary conditions. H. The license fee shall be waived for all dogs or cats if the owner of said dogs or cats has a valid state license for said dogs or cats. (Ord. 5204, 3-10-2014; amd. Ord. 5684, 1-17-2023) 5-1A-4: RABIES VACCINATION REQUIRED: A. Required: Every owner of a dog or cat shall obtain a rabies vaccination for such animal. It shall be unlawful for any person to own or have a dog in his possession six (6) months of age or over which has not been vaccinated against rabies. B. Type Of Vaccine: The rabies vaccination required by subsection A of this section shall be an injection of anti -rabies vaccine approved by the Iowa state department of agriculture, and the frequency of revaccination necessary for approved vaccination shall be as established by subject department. The vaccine shall be administered by a licensed veterinarian and shall be given as approved by the Iowa state department of agriculture. Evidence of said rabies vaccination shall be a certificate of vaccination signed by a licensed veterinarian, and the certificate shall show that the vaccination does not expire within six (6) months from the effective date of the dog or cat license. Whenever a veterinarian inoculates an animal for rabies the veterinarian shall complete a rabies vaccination report which shall be forwarded to the police department, or it's designee. The report shall contain the following information: The name. age. sex and a Page 63 of 114 general description of the animal; the current vaccination date and revaccination date; the vaccination tag number assigned to the animal; the name and address of the animal's owner or custodian. 5-1A-5: LICENSE TAGS: A. Required: The police department, or it's designee city clerk, Animal Control officers and Humane Socicty shall, upon receipt of application, payment of license fee and proof of rabies vaccination, provide to the applicant a license which shall be in the form of a metal tag. Use Of License Tag: Said license tag shall be attached by the owner of a dog or cat to a substantial collar or harness and during the term of license shall be at all times kept on the dog or cat for which the license is issued. This information was finalized at the end of January. • The Finance Department developed the base personnel budgets based on FY25 staffing. Information was provided to departments for review. • Finance has calculated the base budget using updated personnel and current year property valuations. Estimated FY26 contractual information (retirements, new hires, pensions, health care costs and pay rates) were also included. • General Fund Departments were not allowed to enter any budgeting changes for the FY26 Budget. • Departments were directed to review current budgets and if they are in the general fund to email line item -only changes to Finance to enter. • If the department is funded by other revenue than property taxes, they were able to make adjustments to their budgets as needed for Department Requests. • Budget options - Staff, council members, and the public are encouraged to submit additional funding requests to the Finance Department before February 19, 2025. There may not be adequate time to consider suggestions made after the date for the FY26 budget.
