The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa, at 5:30 p.m., on Monday, June 3, 2002. Mayor John R. Rooff in
the Chair. Roll Call: Berry, Welper, Greenwood, Clark, Jordan, Hurley, Getty.
Invocation by: Reverend Belinda Creighton -Smith, Faith Temple Baptist Church.
Pledge of Allegiance: Cammie Scully, Director of Cultural & Arts Commission.
ORAL PRESENTATIONS
117008 - Tim Wilcox stated he was concerned that East 5th Street was not blocked off
during the My Waterloo Days fireworks display. Tom Jennings, Police Chief,
responded that the My Waterloo Days Committee made the decision as to what
streets would be blocked off during the event. Mayor Rooff stated the city
will look at that next year.
Neal Seemann, 2850 Independence Avenue, stated he was concerned with the
process the council uses when making changes to city ordinances. When an
ordinance is on the agenda, the council always suspends the rules and passes
the ordinance on the same night. This does not give citizens enough time to
come before the council to speak about the ordinance because the council
approves the ordinance in one session. Mr. Seemann stated the council needs to
allow people to come to the meeting to speak about the ordinance.
Mayor Rooff responded that the council usually approves the three readings for
an ordinance in one night when they have already held a work session or the
ordinance change is requested from the community. Mayor Rooff stated if the
ordinance change is a major issue for the community, the council takes three
weeks to approve three readings of the ordinance.
Dale Willie, 2648 Saratoga Drive, stated that young people are congregating at
Bontrager Park from 6:00 p.m. to dark. There is a problem with graffiti and
destruction of public property. Mr. Willie reported he spoke with Police Chief
Jennings regarding speeding on Saratoga Drive. There are sex and drug
activities in the park. Mr. Willie stated he has a five year-old neighbor who
likes to ride bike, but can't after 6:00 p.m. because of the activity. Mr.
Willie stated he is concerned someone will get killed. Mr. Willie stated that
Chief Jennings said there are some things in the works regarding this area.

117018 - This being the time and place of public hearing, the Mayor called for written
and oral objections and there were none.
Don Temeyer, City Planner, stated that vacation requests are reviewed by the
Technical Review Committee, notice is mailed to utility companies, reviewed by
the Planning, Programming and Zoning Commission after publication of notice,
placed on the council agenda to set the date of hearing, notice of public
hearing published in the Courier and then placed on the council agenda for the
hearing. Mr. Temeyer stated that staff has been working on the vacation
request for about 60 days. The halfway house issue on tonight's council agenda
has been ongoing for about six months.
Councilperson Jordan stated council agendas are posted on Government Access
Channel 17 throughout the weekend before the council meeting. Councilperson
Hurley stated that since he took office in January he doesn't think the council
has held three separate readings for an ordinance. Councilperson Hurley stated
he feels the council needs to be conscious of this and not automatically
suspend the rules.
Neal Seemann, 2850 Independence Avenue, stated he is not sure this addresses
what he was trying to point out to the council. The rules for public
participation only allows a citizen to speak one time per item for a maximum of
three minutes. Mr. Seemann stated that he feels when there is an ordinance
change, three minutes does not give someone time to address all their points.
Mr. Seemann stated he feels suspending the rules and allowing someone to speak
only three minutes does not allow the public enough time.
Mayor Rooff again explained the procedures in place. Mayor Rooff stated he has
never limited anyone to just three minutes.

Councilperson Berry asked where the city is concerning televising council work
session. City Clerk Nancy Eckert responded that the budget does not allow
hiring enough staff to televise all the meetings, and the work sessions are not
held at a set time each week which makes it hard to schedule a time to televise
for the work sessions.

none.
A representative from Holiday Station Co. stated that Holiday Station takes
underage selling of tobacco very serious. Holiday Station has a new policy
whereby all new associates will be tested by the store, and Holiday Station
will do their own stings a couple of times per month.

Brownfields Economic Development Initiative funds in the amount of $2 million

Prior to a vote on the above motion, the following comments were heard.
Don Temeyer, City Planner, stated that the HUD Brownfield Economic Development
Initiative funds are to be used to finance projects and activities that will
provide near-term results and demonstrable economic benefits, such as job
creation and increases in the local tax base. Mr. Temeyer stated that John
Deere tying into the Rath Area provides economic development and, hopefully,
help create jobs in the Rath Area and this also will tie in with the
redevelopment of the CMC sits.
Following comments a vote was taken on the above motion with the following
result. Ayes: Seven.

that communication from City Planner transmitting an agreement with Hispanic or
Latino Access Association (HOLA) for a loan in the amount of $13,000.00 in
conjunction with a match for a State of Iowa grant to provide an outreach
office for Hispanics be received, placed on file and "Resolution approving said
agreement", be adopted and Mayor and City Clerk authorized to execute same.
Prior to a vote on the above motion, the following comments were heard.
Councilperson Jordan asked if this is a forgivable loan.
Ethel Washington, Director of Waterloo Housing, responded that Waterloo Housing
requested a proposal from the Latino Access Association (HOLA) which outlined
their need for a Housing Coordinator. The loan will be repaid within one year.
The Department of Housing and Urban Development approved the $13,000 loan using
administrative fees.
Following comments a vote was taken on the above motion with the following
result. Ayes: Seven.

Animals, of Section 5-1A-6, Prohibited Acts and Conditions, of Article A, Dogs
and Cats, of Chapter 1, Animal Control, of Title 5, Police Regulation; and
enacting in lieu thereof a new Subparagraph 2, of Paragraph C, Noisy, Annoying
Animals, of Section 5-1A-6, Prohibited Acts and Conditions, of Article A, Dogs
and Cats, of Chapter 1, Animal Control, of Title 5, Police Regulation
(requiring three property owners within 100 yard radius to sign citation)", be
received, placed on file, considered and passed for the first time.
Prior to a vote on the above motion, the following comments were heard.
Mayor Rooff reviewed last week's comments.
Jim Walsh, City Attorney, asked what if there are not three property owners
within 100 yards of the barking dog, what will happen if there is just one
property owner.
Mary Haasis stated she has dogs, cats and horses, and she is sure that some
times her dogs upset the neighbors because people run up and down the fence
which makes her dogs bark. Her neighbor's dogs are tied up. Barking dogs
irritate her and she is sure that irritates her neighbors. It is just children
walking by teasing the animals.

Neal Seemann, 2850 Independence Avenue, stated he is concerned with the
ordinance change. Mr. Seemann reviewed the current ordinance which requires a
written warning, and he is concerned that the warning will be removed from the
ordinance.
Mayor Rooff responded that the only change is requiring three persons within a
100 yard radius to sign the citation.
Mr. Seemann asked why the council is addressing this ordinance and asked how
many citations are issued and how many complaints are received. Mr. Seemann
stated that the City Attorney and Humane Society will only say there are
numerous complaints. Mr. Seemann asked if a record is kept of the number of
calls received concerning barking dogs. Mr. Seemann stated that his abstract
says the property line starts at the middle of the street
Mayor Rooff responded the Humane Society receives thousands of complaints.
Mayor Rooff stated that the council is looking at this ordinance change because
it behooves them to make sure everyone has quality of life, and we feel there
is justification. Mayor Rooff stated the council will only approve the first
reading of this ordinance.
Mr. Walsh stated that the city just wanted the ordinance to be clean. If the
ordinance requires three property owners within 100 yards to sign the citation,
the people can sign the citation and then the complaint will be heard in court.
Lisa Kennedy, 906 Hawthorne, stated her case has been presented in the Courier
as an example. Ms. Kennedy stated that the first step in this, as a Christian,
would be to talk to your neighbor. Ms. Kennedy stated that 100 yards may not
be the proper wording, and some don't have three neighbors. A better wording
would be adjacent which means eight neighbors could sign a citation. Ms.
Kennedy stated it is not fair to have a neighbor a block away to pull from that
distance. At least three out of eight will complain. Ms. Kennedy stated she
feels three adjacent, not adjoining, within 100 yards would be acceptable.
Ann Berry, 137 Rhey, stated she bought a house in a quiet neighborhood, and now
there is a neighbor who has numerous dogs, and the dogs are allowed to be in
her yard. Ms. Berry stated that the dogs are used by her neighbor to
intentionally harass the neighbors. The dogs bark at all hours of the day and
night. Ms. Berry stated the current ordinance does not have any affect because
it requires three adjacent owners. Ms. Berry asked why can't one person be
enough. Ms. Berry read a prepared statement. Ms. Berry stated she fees the
ordinance needs to be changed so that one person with documentation would be
enough.
Don Osborne, 916 Hawthorne, stated he agrees with Ms. Kennedy that the wording
should be changed to three adjacent owners within 100 yards. Mr. Osborne
stated he is against the ordinance proposed tonight. Mr. Osborne stated
requiring only one person to sign the citation is not enough as they could have
a vendetta against their neighbor.
Charles Sievers, 341 Crestridge Drive, stated he has had a dog problem for
quite awhile, and that an ordinance does no good unless it is enforced. Mr.
Sievers stated he thinks when he comes home from Sunday after church, he ought
to be able to lay down and take a nap. Mr. Sievers stated he got three persons
to sign the citation, and the Humane Society said they were not three adjoining
neighbors. Mr. Sievers stated if you have an ordinance there should be someone
responsible for maintaining it. Mr. Sievers stated that in his dealings with
the Animal Control Officers, they say it is not their problem. Mr. Sievers
agreed with the wording on tonight's agenda.
Mayor Rooff stated the city wants an ordinance that is enforceable so that the
Humane Society can do their job.
Councilperson Berry stated she often hears the same concerns about the Humane
Society, and she would like to have a work session with them. Ms. Berry stated
100 yards is inclusive of adjacent/adjoining.
Mr. Walsh stated that the language on tonight's agenda is certainly a more
reasonable approach except when there are not three people within 100 yard of
the line of the offender.
Councilperson Getty suggested a work session with the Humane Society to ask
them what language they feel they can enforce.
Councilperson Welper stated he agrees that 40 or 50 yards is not going to work,
and he feels the council should keep it at 100 yards.

Councilperson Greenwood stated he feels the council needs to do a little more
homework and maybe hold another work session.
Councilperson Hurley asked if the council is concerned with only requiring one
person to sign the citation because of the vendetta issue or is one person good
enough. Mr. Walsh stated that neighbors do get in fights with each other.
Councilperson Welper stated that it is his understanding one person can still
take the offender to court, and Mr. Walsh responded they could go through the
civil court.
