AN ORDINANCE AMENDING ORDINANCE NO. 5079, AS
AMENDED, CITY OF WATERLOO ZONING ORDNANCE,
BY AMENDING THE OFFICIAL ZONING MAP REFERRED
TO IN SECTION 10-4-4, APPROVING A REQUEST BY
MARIA E. SCHNEPF TO REZONE APPROXIMATELY 0 10
ACRES FROM "R-4" MULTIPLE RESIDENCE DISTRICT TO
"R-4, C-Z" CONDITIONAL ZONING DISTRICT TO ALLOW
FOR A RETAIL STORE LOCATED AT 1122 W. 4TH STREET
WHEREAS, the City Council of Waterloo,Iowa,has received a request from
Maria E Schnepf to rezone a parcel of land identified as 1122 W 4th Street, comprising
approximately .10 acres; and
WHEREAS, the subject property is currently zoned as "R-4" Multiple Residence
District, and
WHEREAS, the applicant has requested rezonmg to "R-4, C-Z" Conditional
Zoning District to permit the establishment of a retail store on the premises, and
WHEREAS, all public notices, as required by law, have been timely and properly
provided; and
WHEREAS, a public hearing on said rezoning request was held before the
Waterloo City Council, during which citizens received an opportunity to provide
comments; and
WHEREAS, the City Council finds said request to be consistent with the
Comprehensive Plan and in the best interest of the community
NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WATERLOO, IOWA
1. Ordinance No 5079, as amended, is hereby further amended by changing the
zoning classification of the following described property from "R-4" Multiple Residence
District to "R-4, C-Z" Conditional Zoning District
LOT NO. FOURTEEN(14) IN BLOCK NO. SIX(6)IN WHITNEY AND
SEDGWICK'S ADDITION TO THE CITY OF WATERLOO, IOWA, EXCEPT
THAT PART THEREOF DESCRIBED AS FOLLOWS BEGINNING AT A
POINT ON THE SOUTHEAS 1'bRLY LINE OF SAID LOT NO. FOURTEEN
(14) WHICH IS THIRTY AND SIXTEEN HUNDREDTHS (30 16) FEET
NORTHEASTERLY OF THE MOST SOUTHERLY CORNER OF SAID LOT;
THENCE NORTHWESTERLY TO A POINT ON THE NORTHWESTERLY
LINE OF SAID LOT WHICH IS TWENTY-NINE AND SEVENTY-SIX
HUNDREDTHS (29 76) FEET NORTHEASTERLY FROM THE MOST
WESTERLY CORNER OF SAID LOT, THENCE NORTHEASTERLY ALONG
THE NORTHWESTERLY LINE OF SAID LOT TO THE MOST NORTHERLY
CORNER OF SAID LOT; THENCE SOUTHEASTERLY ALONG THE
NORTHEASTERLY LINE OF SAID LOT TO THE MOST EAS i'hRLY
CORNER OF SAID LOT, THENCE SOUTHWESTERLY ALONG THE
SOUTHEASTERLY LINE OF SAID LOT TO THE PLACE OF BEGINNING.

2. The Official Zoning Map referred to in Section 10-4-4 of the Waterloo City
Code is hereby amended in accordance with the change in zoning classification set forth
in Section 1 of this ordinance
3 The rezoning to "R-4, C-Z" is subject to the following conditions, which shall
run with the land and apply to all future owners
• The parcel shall be utilized only for a retail store, as proposed.
4 All ordinances or parts of ordinances in conflict herewith are repealed
5. If any section, provision, or part of this ordinance shall be adjudged to be
unconstitutional or invalid, such adjudication shall not affect the validity of the ordinance
as a whole, or any section,provision, or part thereof not adjudged invalid or
unconstitutional.
6 This ordinance shall be in full force and effect from and after its final passage,
approval, and publication as required by law.
