RESOLUTION APPROVING SECOND AMENDMENT TO
DEVELOPMENT AGREEMENT WITH DEER CREEK
DEVELOPMENT, LLC AND DIRECTING EXECUTION OF
SAID AGREEMENT BY MAYOR.
BE IT RESOLVED BY THE COUNCIL OF THE CITY .OF WATERLOO, IOWA,
that the Second Amendment to the original Development Agreement
dated October 16, 2006, to strike Section 3 in its entirety and
to add a new Section 3 changing the repayment schedule by the
City to the developer for infrastructure improvements previously
put in place, by and between Deer Creek Development, LLC of
Waterloo, Iowa and the City of Waterloo, Iowa, be and the same is
hereby approved, and the Mayor and City Clerk authorized to
execute the same in behalf of the City of Waterloo, Iowa.
PASSED AND ADOPTED this 14th day of March, 2011.
