RESOLUTION NO. 2025-130
A RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF CITY -OWNED PROPERTY, A PORTION
OF MIRIAMS PARK, LOCATED EAST OF 3843 SAGER
AVENUE, TO WATERLOO SCHOOLS, IN THE AMOUNT OF
$1.00, WITH SPECIFIED EASEMENTS AND CONDITIONS
ON THE USE OF THE LAND, AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID
DOCUMENTS.
WHEREAS, the City of Waterloo owns a portion of Miriams Park located east of 3843
Sager Avenue, which is not essential for municipal purposes; and
WHEREAS, Waterloo Schools has requested to purchase this property for $1.00 for
continued use as open space, an injection well for the cooling system of the adjacent school
building, and a new controlled -access roadway for a new high school; and
WHEREAS, the City wishes to retain certain rights, including an access easement and utility
easement as shown on the Plat of Survey; and
WHEREAS, Waterloo City Council will retain the right to approve any future changes to
these use restrictions, upon request by the Waterloo Community Schools;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo as
follows:
1. The sale and conveyance of a portion of the City -owned property at Miriams Park to
Waterloo Schools for the amount of $1.00 is hereby authorized.
2. The conveyance is subject to:
• Retention of an access easement and utility easement as shown on the Plat of
Survey.
• The land being deeded to Waterloo Schools for continued use as open space, an
injection well for the cooling system, and a controlled -access roadway.
• Any future changes to these restrictions requiring approval by the Waterloo City
Council after a request by Waterloo Community Schools.
3. The Mayor and City Clerk are hereby authorized and directed to execute said
documents on behalf of the City of Waterloo, Iowa.
4. This resolution shall become effective immediately upon its approval and adoption by
the City Council.
