RESOLUTION NO. 2011-1073 RESOLUTION APPROVING THE REQUEST OF HOWARD L. ALLEN INVESTMENTS, INC. FOR A MINOR SITE PLAN AMENDMENT TO THE "S-1" SHOPPING CENTER COMMERCIAL DISTRICT AND AN ALTERATION OF THE PARKING REQUIREMENTS FOR THE PROPERTY GENERALLY DESCRIBED AS BEING EAST OF 2825 CROSSROADS BOULEVARD, TO ALLOW FOR THE DEVELOPMENT OF A RETAIL STRIP CENTER WITH A 71 STALL PARKING LOT, APPROXIMATELY 13 STALLS LESS THAN THE APPROXIMATE 84 STALL REQUIRED IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. WHEREAS, it has been proposed that the Council of the City of Waterloo, Iowa, approve the request of Howard L. Allen Investments, Inc. for a minor Site Plan Amendment to the "S-1" Shopping Center Commercial District and an alteration of the parking requirements for the property generally described as being east of 2825 Crossroads Boulevard, to allow for the development of a retail strip center with a 71 stall parking lot, approximately 13 stalls less than the approximate 84 stall required, legally described as follows: A parcel of land located in the East Half of Section No. 2, Township No. 88 North, Range No. 13 West of the Fifth Principal Meridian, in the City of Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the intersection of the Southeasterly right of way line of East San Marnan Drive and the Southwesterly right of way line of Sears Street; thence South 41 degrees 24 minutes 00 seconds East along the Southwesterly right of way line of Sears Street a distance of 194.51 feet; thence Southerly along a curve concave Westerly having a radius of 20.00 feet a distance of 31.42 feet to the Northwesterly right of way line of Crossroads Boulevard; thence South 48 degrees 36 minutes 00 seconds West along the Northwesterly right of way line of Crossroads Boulevard a distance of 220.00 feet to the point of beginning; thence North 41 degrees 24 minutes 00 seconds West a distance of 250.00 feet; thence South 48 degrees 36 minutes 00 seconds West a distance of 209.82 feet; thence South 41 degrees 24 minutes 00 seconds East a distance of 250.00 feet; thence North 48 degrees 36 minutes 00 seconds East along the Northwesterly right of way line of Crossroads Boulevard a distance of 209.82 feet to the point of beginning. Note: The Southwesterly right of way line of Sears Street is assumed to bear South 41 degrees 24 minutes 00 seconds East, all in the City of Waterloo, Black Hawk County, Iowa; WHEREAS, due to the insignificant nature of said minor Site Plan Amendment, the Council did not deem it necessary to hold a public hearing, and WHEREAS, it is the opinion of this Council that said minor Site Plan Amendment should be approved as proposed. Resolution No. 2011-1073 Page 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that a minor Site Plan Amendment to the "S- 1" Shopping Center Commercial District and an alteration of the parking requirements for the property generally described as being east of 2825 Crossroads Boulevard, to allow for the development of a retail strip center with a 71 stall parking lot, approximately 13 stalls less than the approximate 84 stall required, be and the same is hereby approved.
