NOTICE OF PUBLIC HEARING
FOR PROPOSED PUBLIC IMPROVEMENT
Notice is here Iver that on May 5,2025 at 5:30 p.m.in the council chambers in
city hall in the i[y of Waterloo.Iowa,a public hearing will be held on the proposal
to acquire ownershipp,to acquire permanent easements,and to acquire temporary
easements for the La Porte Road Reconstruction Phase II Project.The subject
properties are generally located on La Porte Road between just south of Plymouth
Avenue and Hawthorne Avenue
The City of Waterloo may acquire part or all of the above-described property Inter-
ests by condemnation,Following public hearing as described herein,the City of Wa-
terloo will vote on whether to proceed with the project,to make final selection of the
location.to authorize fundingg for the public improvement project.and determine that
there is a reasonable expecEation the city will be able to achieve its public purpose,
comppI with all applicable standards,and obtain the necessary permits.It approved,
the Ci�y of Waterloo shall otter to purchase said property antl easements from the
property ownersfor no less than the fair market value of said property Interests,and
if negotiations are unsuccessful then the City of Waterloo shall acquire the property
and easements in accordance with the condemnation procedures prescribed by
Iowa law.
You are also advised that Iowa law provides you with certain rights with respect to
acquisition of your property or any interest therein.If applicable,relocation benefits
may also be available to you.A statement of these rights is enclosed with this notice.

STATEMENT OF PROPERTY OWNER'S RIGHTS
Just as the law grants certain entities the rightty acquire private property,you as the
owner of the property have certain rights.You have the right to:
1.Receive ust compensation for the taking of property.(Iowa Constitution,Article
I,section 1 )
2.An offer to purchase which may not be less than the lowest appraisal of the fair
market value of the property.(Iowa Cade section 615.45;Iowa Code section 69.54)
3.Receive a copy of the apppralsal.If an appraisal is required,upon which the ac-
quiring agency's determinatlon of just compensation is based not less than ten days
before being contacted by the acquiring agency's acquisition agent.(Iowa Code
section 6B.45)
4.An opportunity So accompany at least one appraiser of the acquiring agency who
appraises your propertywhen an appraisal is required.(lowa Code section 68.54)
5.Participate In good-faith negotiations with the acquiring agency before the acquir-
ing agency begins condemnation proceedings.(Iowa Code section 63.3)
6.A determination of just compensation by an impartial compensation commission
and the right to appeal its award to the district court if you cannot agree on a pur-
chase price with the acquiring agency(Iowa Code section 613 ;Iowa Code section
68.7;Iowa Cade section 66.18)
7.A review by the compensation commission of the necessity for the condemna-
tion If your property Is agricultural land being condemned for industry.(iowa Code
section 6B.4A)
8.Payment of the agreed upon purchase price or.if condemned,a deposit of the
compensation commission award before you are required to surrender possession
