RESOLUTION NO. 2025-247
A RESOLUTION APPROVING AN EARLY ACCESS
AGREEMENT WITH INTERNATIONAL PAPER COMPANY,
TO ALLOW CERTAIN DEVELOPMENT ACTIVITIES ON
LAND LOCATED AT 3230 LEVERSEE ROAD, NORTH OF
3040 LEVERSEE ROAD, AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE SAID DOCUMENT.
WHEREAS International Paper Company has identified a need to commence certain
development activities prior to formal closing or conveyance of property located at 3230
Leversee Road, situated north of 3040 Leversee Road, within the City of Waterloo; and
WHEREAS, an Early Access Agreement is required to grant International Paper
Company the temporary right to enter and utilize said land for pre -development purposes, such
as site investigation, surveying, environmental assessments, and preliminary grading, subject to
conditions mutually agreed upon by the parties; and
WHEREAS, such Early Access is in the best interest of the City as it will facilitate
expeditious project timelines while safeguarding municipal and public interests through specified
legal controls and indemnifications; and
WHEREAS, the proposed Early Access Agreement has been reviewed by City staff and
legal counsel.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo as
follows:
1. That the Early Access Agreement with International Paper Company for land located at
3230 Leversee Road, north of 3040 Leversee Road, allowing for specified development activities
prior to final closing or property transfer, is hereby approved.
2. That the Mayor and City Clerk are authorized and directed to execute said document on
behalf of the City of Waterloo, Iowa.
