RESOLUTION NO. 2025-259 RESOLUTION APPROVING THE REQUEST OF TOM HANSEN FOR A WAIVER FOR A CONCRETE DRIVEWAY, LOCATED AT 365 FOUR SEASONS DRIVE, WITH THE ELIMINATION OF THE SIDEWALK SECTION DUE TO INABILITY TO MEET GRADE REQUIREMENTS. WHEREAS, Tom Hansen, the property owner of 365 Four Seasons Drive, has applied for a waiver to allow the construction of a concrete driveway with the elimination of the sidewalk section due to the inability to meet grade requirements, and; WHEREAS, the Engineering Department, after reviewing the request, has determined that compliance with the standard sidewalk requirement is not feasible due to the specific topographical challenges present at this location, and; WHEREAS, the proposed driveway configuration does not negatively impact pedestrian accessibility and safety and maintains compliance with applicable city ordinances and land use policies, and; WHEREAS, the waiver will not adversely affect the public health, safety, or welfare and is consistent with the intent and purpose of the municipal code. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, 1. The request from Tom Hansen for a waiver for the installation of a concrete driveway at 365 Four Seasons Drive is hereby approved, and the requirement for a standard sidewalk section is waived due to an inability to meet grade requirements, subject to the following conditions: a) Work is to be performed by an approved and bonded contractor. b) A permit is to be obtained from the office of the City Engineer prior to construction. c)All work shall be under the supervision of the City Engineer and at no cost to the City of Waterloo d) The City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record. 2. The City Engineer is authorized and directed to take necessary steps to implement this resolution in accordance with applicable city codes and policies. PASSED AND ADOPTED this 5th day of May 2025.
