HomeMy WebLinkAboutCorridor_Fire_Marshals_Mobile_Food_Vendor_Fire_Inspection_Agreement_-_6.2.2025 Docusign Envelope ID:01103EED-C1AO-4BA5-8038-OC40EB96CC3F Corridor Fire Marshals Mobile Food Vendor Fire Inspection Agreement The Fire Marshal's Offices of the Fire Departments of Cedar Falls, Waterloo, Hiawatha, Marion, Cedar Rapids, North Liberty, Tiffin, Iowa City, and the University of Iowa (collectively, "the Parties") hereby enter into this Agreement for the fire inspections of mobile food vending units. WHEREAS, the Fire Marshal's Offices of the Parties regularly inspect mobile food vending units in their respective jurisdictions; and WHEREAS, mobile food vendors in the area of the 1-380 corridor operate in the jurisdiction of the Parties; and WHEREAS, the Parties desire to create an understanding that fire inspections performed by any of the Parties will be considered valid by the other Parties, for a period of one year after such inspection. NOW, THEREFORE, in consideration of the mutual promises and agreements set forth herein, the Parties agree as follows: I. SCOPE. This Agreement applies to any fire inspection of a mobile food vending unit conducted by any of the Parties.A"mobile food vending unit" is a food establishment that is self- contained and readily movable, such as a food cart, bustaurant, or food truck 2. TERM. This Agreement shall terminate only upon the agreement of a majority of the Parties. Any Party may terminate their obligations pursuant to this Agreement by providing the other Parties 30 days' advance written notice. A city may enter into this Agreement upon consent of all of the Parties to the Agreement at the time of application, and upon that applicant city's consent to the terms of this Agreement. 4. INSPECTION RECIPROCITY. a. Upon successfully passing a fire inspection, the mobile food vendor will be provided with a sticker(color-coded and dated with year, as well as punched for the month) that will be placed near the entry door to the unit. The vendor will also be given a paper copy certificate of fire inspection completion to be presented to any of the city entities involved in permitting the operation of mobile food vendor units. The approximate form of the sticker is attached hereto as Exhibit "A." The form of the certificate is attached hereto as Exhibit`B." Changes to these forms may be made by agreement of a majority of the Parties. A valid certificate issued pursuant to this Agreement shall be deemed to be a passed fire inspection in each Party, if issued within the previous year. b. The Party conducting the fire inspection shall charge its permit fee for mobile food vendors. Mobile food vendors will be responsible for such permit fees in all jurisdictions requiring the same but shall not be required to have additional fire inspections in each Party jurisdiction. C. Each Party shall purchase the registration stickers as needed from Banacom signs in Hiawatha, Iowa. The cost of such sticker shall not exceed $5.00/each. d. A mobile food vendor inspection roundup may be held each year in the spring to inspect as many units as possible with possible future expansion to up to three dates Page 2 of 11 Docusign Envelope ID:01103EED-C1AO-4BA5-8038-OC40EB96CC3F in three different cities. The Parties shall share information about the round-up on their websites and/or social media pages. e. A shared file has been created, and access is provided to each Party, where they shall store files, inspections, and appropriate related documents. The Parties shall use the agreed-upon inspection form checklist to complete inspections, attached hereto as Exhibit"C."Each entity shall enter the inspections into their own record- keeping software as needed. The forms will be kept in a shared file for review by other Parties. A copy of this Agreement and the signature pages shall also be kept in this shared file. e. This Agreement shall not be used by any Party to refuse inspection of any mobile food vendor. £ Inspections performed under this Agreement shall not serve to satisfy any separate licensing or permitting requirements that apply to mobile food vendors in any individual Party's jurisdiction. Such separate licensing or permitting requirements shall be separately administered by each individual Party. Mobile Food Vendors shall be advised at the time of inspection that separate licensing or permitting requirements may apply depending upon the Party involved. 5. ENTIRE AGREEMENT. This Agreement contains the entire agreement and understanding by and between the Parties with respect to the subject matter hereof. No change or modification hereof shall be valid or binding unless the same is in writing and signed by a majority of the Parties to this Agreement. Nothing in this Agreement shall be construed to waive any immunity each Party may have regarding performance of fire inspections.Any Party signing this Agreement does not accept responsibility or liability for inspections performed by another Party. 6. NOTICE. AUTHORIZATION. Each Party to this Agreement represents and warrants to the others that: a. It has the right,power, and authority to enter into and perform its obligations under this Agreement. b. It has taken all requisite action to approve execution, delivery, and performance of this Agreement, and that this Agreement constitutes a legal, valid, and binding obligation upon itself in accordance with its terms. 8. SEVERABILITY. It is the intent of the Parties that each section, paragraph, sentence, clause, and provision of this Agreement is distinct. If any provision is held invalid for any reason, such a finding does not affect the remainder of the Agreement. 9. NO ASSIGNMENT. No Party shall assign, subcontract, or otherwise transfer any interests or obligations under this Agreement to any other entity without the other Parties' prior written approval. 10. SIGNATURES. This Agreement shall be executed in duplicate, each Party retaining one copy. The remainder of this page is left intentionally blank. The signature page follows. LP gas alarm Pass_ Fail A listed LP-gas alarm shall be installed within the vehicle in the vicinity of LP-gas system components, in accordance with the manufacturer's instructions.
