RESOLUTION NO. 2025-338
RESOLUTION APPROVING AN EARLY ACCESS
AGREEMENT WITH CEDAR RIVER CONTRACTING INC.,
D/B/A K & W ELECTRIC, INC, TO ALLOW CERTAIN
DEVELOPMENT ACTIVITIES ON LAND LOCATED EAST OF
180 WARP DRIVE, AND AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE SAID DOCUMENT.
WHEREAS Cedar River Contracting Inc., d/b/a K & W Electric, Inc. has requested early
access to land located east of 180 Warp Drive for the purpose of commencing specific
development activities; and
WHEREAS, the early access agreement outlines the scope of permissible activities, in
accordance with applicable laws and regulations; and
WHEREAS, granting early access will facilitate the timely progression of development
activities that are essential to begin early earth work activities, other site preparation and
foundation of the new building prior to the land being conveyed; and
WHEREAS, the terms and conditions of the Early Access Agreement have been reviewed
and found satisfactory by the City's planning department, ensuring that the interests of the City
are protected and that all activities undertaken are compliant with existing land use policies and
ordinances; and
WHEREAS, it is deemed in the best interest of the City to approve this agreement to
promote orderly development and economic growth;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA,
1. The Early Access Agreement with Cedar River Contracting Inc., d/b/a K & W
Electric, Inc., for the land located east of 180 Warp Drive is hereby approved.
2. The Mayor and City Clerk are authorized and directed to execute said documents on
behalf of the City of Waterloo, Iowa.
