RESOLUTION NO. 2012-1135 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PUBLIC ALLEY LOCATED NEXT TO 35 FLETCHER AVENUE TO CARBER DEVELOPMENT, LC, FOR $4,180.89, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $4,180.89, plus costs, has been made by Carber Development, LC, and WHEREAS, a public hearing was held on December 3, 2012, at 5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Carber Development, LC, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on November 27, 2012, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Carber Development, LC to purchase real property for the sum of $4,180.89, and costs, be and it is hereby accepted for real property described below: That part of Block Twenty-six (26), Westfield and a part of the Southeast Quarter (SE1/4) of Section Twenty-two (22), Township Eighty-nine North (T89N), Range Thirteen West (R13W) of the Fifth Principal Meridian, City of Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the Southwest corner of Lot Two (2), aforesaid Block Twenty-six (26); thence N89°40'34"E Sixteen and Ten Hundredths (16.10) feet along the South line of said Lot Two (2) to the Southeast corner of parcel described in Document No. 2010-18771 in the Black Hawk County Recorder's Office and to the point of beginning; thence N89°40'34"E One Hundred Fifty-eight and Twenty Hundredths (158.20) feet still along said South line to the Southeast corner of aforesaid Parcel; thence S59°20'56"E Thirty-one and Eight Hundredths (31.08) feet to the North line of Lot Six (6), aforesaid Block Twenty-six (26), and to the Northwest corner of Tract "A", City Lot Deed 619, page 788 in aforesaid Recorder's Office; thence S89041101"W One Hundred Eighty-nine and Forty Hundredths (189.40) feet along said North line, and along the North line of Lot Six (6), Lot Five (5), Lot Four (4), and Lot Three (3), Resolution No. 2012-1135 Page 2 said Block Twenty-six (26) to the Northeast corner of Tract "B", said City Lot Deed; thence N15033158"E Sixteen and Sixty-one Hundredths (16.61) feet to the point of beginning, containing 2778 square feet. 3. That the City of Waterloo, Iowa convey said parcel of real property to Carber Development, LC by deed. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Carber Development, LC. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Carber Development, LC upon receipt of the sum of $4,180.89, and costs.
