RESOLUTION SETTING THE DATE OF PUBLIC HEARING
AS OCTOBER 10, 2016 FOR A REQUEST BY KWIK TRIP,
INC. TO REZONE APPROXIMATELY 3.94 ACRES FROM "C-
2" COMMERCIAL DISTRICT TO "M-2,P" PLANNED
INDUSTRIAL DISTRICT FOR THE PURPOSES TO ALLOW
FOR THE CONSTRUCTION OF BIODIESEL BLENDING
FACILITY, LOCATED DIRECTLY NORTHEAST OF 4901
SERGEANT ROAD, AND INSTRUCT CITY CLERK TO
PUBLISH PERTINENT NOTICE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS
FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa, shall meet in the Harold E.
Getty Council Chambers, at City Hall, Waterloo, Iowa at 5:30 p.m. on the 10th day of October,
2016, for the purpose of considering and acting upon a request to rezone approximately 3.94
acres from "C-2" Commercial District to "M-2,P" Planned Industrial District for the purposes to
allow for the construction of biodiesel blending facility, located directly northeast of 4901
Sergeant Road, and legally described as follows:
A part of the Southwest Fractional Quarter(SW 1/4) of Section 7 , Township
Eighty-eight (88) North, Range Thirteen (13) and a part of the Southeast
quarter (SE 1/4) of Section Twelve (12), Township eighty-eight (88) North,
Range Fourteen (13) West of the 5th P.M., in Waterloo, Black Hawk
County, Iowa, bounded as follows:
Beginning at a point on the West line of said Section Seven (7) which is
1066.45 feet North of the Southwest corner of said Section (said point
being on the southeasterly right of way line of U.S. Hwy 63); Thence North
36°02' East along said right of way line 44 feet;
Thence South 53°58' East 500 feet;
Thence South 36° 02' West 344 feet;
Thence North 53°58' West 281.77 feet to the West line of Section Seven
(7) at a point 370.98 feet South of the point of beginning;
Thence continuing along the last described course into Section 12, 218.23
feet to the Southeasterly right-of-way line of said highway;
Thence North 36°02' East along said right of way line 300 feet to the point
of beginning.
Section 2. That the City Clerk is hereby directed to publish notice of the time and place
of said hearing in the Waterloo Courier.
