RESOLUTION NO. 2012-685
RESOLUTION GRANTING PERMISSION TO CHRIS
FISCHELS FOR A WAIVER FOR A CONCRETE DRIVEWAY
TO BE LOCATED AT 2740 CEDAR TERRACE DRIVE,
AND AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY WITH ELIMINATION OF THE SIDEWALK
SECTION DUE TO THE INABILITY TO MEET
REQUIREMENTS OF THE DRIVEWAY AND SIDEWALK
POLICY, PARAGRAPH 1.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Chris Fischels be authorized and
permitted to construct a concrete driveway with elimination of
the sidewalk section due to the inability to meet requirements of
the driveway and sidewalk policy, paragraph 1, to be located at
2740 Cedar Terrace Drive, and legally described as follows:

R 13 COM AT A PT ON CENTERLINE HWY 218 THAT IS 1108.84
FT SELY FROM INTERS CENTERLINE HWY 218 WITH W LINE GOVT

RT ANGS 195 FT TH NELY AT RT ANGS TO E LINE GOVT LOT 3
TH NLY ALONG E LINE TO CENTERLINE CO RD 258 TH NWLY
ALONG CO RD 258 TO A PT THAT IS 261.6 FT FROM PT OF BEG
TH SWLY TO PT OF BEG;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Chris Fischels to construct a concrete driveway
with elimination of the sidewalk section due to the inability to
meet requirements of the driveway and sidewalk policy, paragraph
1, to be located at 2740 Cedar Terrace Drive, subject to the
following conditions:
1. Work to be performed by an approved and bonded
contractor.
2. A permit is to be obtained from the office of the City
Engineer prior to construction.
3. All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
