RESOLUTION NO. 2025-423
RESOLUTION APPROVING SUPPLEMENTAL AGREEMENT
NO. 1, TO A PROFESSIONAL SERVICES AGREEMENT
WITH FOTH INFRASTRUCTURE AND ENVIRONMENT,
LLC, ORIGINALLY EXECUTED MARCH 17, 2025, IN AN
AMOUNT NOT TO EXCEED $541,131.00, IN CONJUNCTION
WITH THE FY 2026 KATOSKI DRIVE AND HUNTINGTON
ROAD RECONSTRUCTION, CONTRACT NO. 1123, AND
AUTHORIZING THE MAYOR TO EXECUTE SAID
DOCUMENT.
WHEREAS, the City of Waterloo previously entered into a Professional Services
Agreement with Foth Infrastructure and Environment, LLC on March 17, 2025, for the provision
of engineering and related services; and
WHEREAS, it is necessary and desirable to enter into Supplemental Agreement No. 1 to
said Professional Services Agreement to encompass additional services required for the FY 2026
Katoski Drive and Huntington Road Reconstruction, identified as Contract No. 1123; and
WHEREAS, Foth Infrastructure and Environment, LLC has agreed to provide additional
professional services as delineated in the Supplemental Agreement No. 1 for a total amount not
to exceed $541,131.00; and
WHEREAS, the City Council of the City of Waterloo finds that it is in the best interest of
the City to approve Supplemental Agreement No. 1 and to authorize the Mayor to execute the
same on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA,
1. That Supplemental Agreement No. 1 to the Professional Services Agreement with Foth
Infrastructure and Environment, LLC, in an amount not to exceed $541,131.00, pertaining to the
FY 2026 Katoski Drive and Huntington Road Reconstruction, Contract No. 1123, is hereby
approved.
2. That the Mayor is authorized and directed to execute said documents on behalf of the
City of Waterloo, Iowa.
