RESOLUTION NO. 2025-439
RESOLUTION APPROVING ACKNOWLEDGMENT/SETTLEMENT
AGREEMENT FOR TOBACCO VIOLATION - FIRST OFFENSE WITH
EXPRESS MART, 2027 FALLS AVENUE, AND ACCEPTANCE OF A
CIVIL PENALTY IN THE AMOUNT OF $300.00, AND
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
SAID DOCUMENT.
WHEREAS, Express Mart, located at 2027 Falls Avenue, Waterloo, Iowa, has been
identified as being in violation of state tobacco laws concerning the sale of tobacco products to
minors, which constitutes a first offense; and
WHEREAS, an Acknowledgment/Settlement Agreement has been proposed for this first
offense, which includes the acceptance of a civil penalty to be imposed on Express Mart; and
WHEREAS, the proposed civil penalty for this offense is $300.00, in accordance with
applicable state and local regulations.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA,
1. The City Council hereby approves the Acknowledgment/Settlement Agreement
concerning the tobacco violation as a first offense with Express Mart, located at 2027 Falls
Avenue, Waterloo, Iowa, acknowledging their responsibility and accepting the terms of the
settlement.
2. A civil penalty in the amount of $300.00 shall be accepted as full settlement of the first
offense tobacco violation by Express Mart.
3. The Mayor and City Clerk are authorized and directed to execute said document on
behalf of the City of Waterloo, Iowa.
