RESOLUTION NO. 2025-442
RESOLUTION APPROVING A VARIANCE TO THE
REQUIREMENTS OF THE SUBDIVISION ORDINANCE IN
SECTION 11-3-2 PRELIMINARY PLATS AND SECTION 11-3-
3 FINAL PLATS, RELATING TO THE APPROVAL OF THE
MINOR PLAT OF AUSTIN'S PLAT, A TWO -LOT
COMMERCIAL SUBDIVISION IN THE "C-P" PLANNED
COMMERCIAL DISTRICT LOCATED EAST OF 122 BLACK
HAWK ROAD.
WHEREAS, the City of Waterloo Subdivision Ordinance specifies requirements for the
submission and approval of plats including, but not limited to, Section 11-3-2 Preliminary Plats
and Section 11-3-3 Final Plats; and
WHEREAS, a request has been made by the City of Waterloo for a variance from the
requirements of said sections for a two -lot commercial subdivision known as Austin's Plat,
situated in the "C-P" Planned Commercial District located east of 122 Black Hawk Road; and
WHEREAS, the proposed variance seeks to allow the subdivision to proceed with
approval under conditions differing from standard Preliminary and Final Plat procedures, as
stipulated in the Subdivision Ordinance; and
WHEREAS, the City Council has considered the planning and zoning criteria, input from
the public and stakeholders, and recommendations from the Planning and Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA,
1. The variance to the requirements of Section 11-3-2 Preliminary Plats and Section 11-3-
3 Final Plats of the Subdivision Ordinance for the Minor Plat of Austin's Plat, a two -lot
commercial subdivision, is hereby approved.
