RESOLUTION TO APROVE A REQUEST BY MICHELE N. ISOM (FORMERLY KNOWN AS MICHELE N. CLARK) FOR AN ENCROACHMENT AGREEMENT TO ALLOW FOR A FENCE ON CITY-OWNED RIGHT-OF-WAY IN THE “R-2” ONE-
AND TWO-FAMILY RESIDENCE DISTRICT LOCATED NORTH OF 760 CLOVERDALE AVENUE ON LUCAS STREET, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT.
WHEREAS, Michele N. Isom, formerly known as Michele N. Clark, has requested approval to enter into an Encroachment Agreement to install a fence on city-owned right-of-way located north
of 760 Cloverdale Avenue on Lucas Street; and
WHEREAS, the City of Waterloo recognizes the need to accommodate reasonable use of adjacent right-of-way by property owners, provided that such encroachments do not adversely affect
public access, safety, or City operations; and
WHEREAS, the requested encroachment is situated in the “R-2” One- and Two-Family Residence District and has been reviewed for compliance with zoning ordinances and public safety standards;
and
WHEREAS, it is necessary for the City Council to formally approve the Encroachment Agreement and authorize city officials to execute the necessary documents to allow the installation
of the fence
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
1. The Encroachment Agreement with Michele N. Isom to permit the installation of a fence on city-owned right-of-way north of 760 Cloverdale Avenue is hereby denied.
