RESOLUTION NO. 2012-450 RESOLUTION ACCEPTING AND APPROVING ACQUISITION OF PROPERTY GENERALLY LOCATED AT 335 AND 425 ALMOND STREETS; 520 COTTAGE STREET; 115 SMITH STREET; 426 AND 311 ADAMS STREET; 616-618 WEST 9TH STREET; AND 214-216 INDEPENDENCE AVENUE IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. WHEREAS, Iowa Code Section 657A.10A allows cities to petition the courts for possession of vacant and dilapidated homes, of which no one will take responsibility for its condition, and WHEREAS, the hereinafter described parcels contain a vacant dwelling that has been deemed dangerous and unsafe and does not meet the City of Waterloo's Housing Code, and WHEREAS, it is the intention of the City of Waterloo to demolish the dangerous buildings immediately, and WHEREAS, after said demolition, the City of Waterloo will be able to offer the properties to the adjacent property owners or interested parties for a reasonable cost, and WHEREAS, the Iowa District Court for Black Hawk County found that proper Notice of Intent to Take Default against several parties was properly mailed, and WHEREAS, the Iowa District Court for Black Hawk County found: 1. That 335 Almond Street, legally described as follows: The West 51 feet of Lot No. 4 in Block No. 65 in The Cooley Addition to Waterloo, Iowa; 2. That 425 Almond Street, legally described as follows: Lot 4 in Block 66 in The Cooley Addition to Waterloo, Black Hawk County, Iowa; 3. That 520 Cottage Street, legally described as follows: Lot 2 in Block 1 in Howery & McWilliams Addition to the City of Waterloo, Iowa; 4. That 115 Smith Street, legally described as follows: The West 411--� feet of the East 511-� feet of the North 10 feet of Lot 6; and Resolution No. 2012-450 Page 2 The West 411-� feet of the East 511-� feet of Lot 7, all in C.O. Balliett and F.L. Gilberts Sub - Division of the East half of Lot No. 2 and the West half of Lot No. 3 and Hardy and Virdens Plat of the South East quarter of Section 24, Township 89 North of Range 13 West of the 5th P.M. in the City of Waterloo, Black Hawk County, Iowa; 5. That 426 Adams Street, legally described as follows: Lot No. 3 in Block No. 12 in North Addition, in Waterloo, Iowa; 6. That 311 Adams Street, legally described as follows: Lots 17 and 18 and the East 33 feet 6 inches of the South 100 feet of Lot 16, Block 11, in North Addition to the City of Waterloo, Black Hawk County, Iowa; 7. That 616-618 West 9th Street, legally described as follows: The Northeasterly 46 feet and 8 inches of Lot 10 in Block 11 in Doe's Addition to the Village (now City) of Waterloo, Black Hawk County, Iowa; 8. That 214-216 Independence Avenue, legally described as follows: Lot No. 3 in W.L. Illingsworth's Addition to the City of Waterloo, Black Hawk County, Iowa; are residences located in Waterloo, Black Hawk County, Iowa. There are no utilities being provided to the properties. The properties are unoccupied and have been vacant for a number of years. The properties do not meet the City's Housing Code for being fit for human habitation or occupancy. The buildings have been exposed to the elements for many years, which has made them deteriorate substantially. 2. That because of the findings of fact made by the Iowa District Court of Black Hawk County, it was determined that the properties are an abandoned building pursuant to Section 657A.10A. WHEREAS, the Iowa District Court of Black Hawk County ordered, adjudged and decreed that the above described properties are an abandoned property pursuant to Section 657A.10A and awarded title of said property to the City of Waterloo, and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the above described properties are accepted and approved for the purposes as described in Section 657A.10A.
