RESOLUTION NO. 2025-458
RESOLUTION APPROVING REQUEST OF MAYWOOD
REAL ESTATE, LLC, FOR A WAIVER FOR A CONCRETE
DRIVEWAY, LOCATED AT 108 OGDEN AVENUE, AND
AUTHORIZING THE CONSTRUCTION OF AN ASPHALT
DRIVEWAY AND PLACING A DRIVEWAY OR SIDEWALK
ON CITY-OWNED RIGHT-OF-WAY ON AN UNIMPROVED
STREET.
WHEREAS Maywood Real Estate, LLC, the property owner at 108 Ogden Avenue, has
submitted a request for a waiver to construct an asphalt driveway and to place a driveway or
sidewalk on the City right-of-way on an unimproved street; and
WHEREAS, the proposed construction involves placing the driveway partially on the city
right-of-way, which is located on an unimproved street; and
WHEREAS, after due consideration, the City Council deems it appropriate to allow such
construction under specific conditions and in compliance with all applicable city codes and
standards.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA,
1. The request of Maywood Real Estate, LLC for a waiver to construct an asphalt
driveway at 108 Ogden Avenue, is hereby approved, subject to the following conditions:
a) Work is to be performed by an approved and bonded contractor.
b) A permit is to be obtained from the office of the City Engineer prior to construction.
c)All work shall be under the supervision of the City Engineer and at no cost to the City
of Waterloo.
d) The City Clerk is authorized and directed to forward a certified copy of this resolution
to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing
in order that this said action may become a matter of official County Record.
2. The City Engineer is authorized and directed to take necessary steps to implement this
resolution in accordance with applicable city codes and policies.
PASSED AND ADOPTED this 18`h day of August 2025.
