RESOLUTION NO. 2012-1077
RESOLUTION APPROVING REVISED SECOND AMENDMENT
TO DEVELOPMENT AGREEMENT WITH CRYSTAL
DISTRIBUTION SERVICES, INC. OF WATERLOO, IOWA
AND DIRECTING EXECUTION OF SAID AMENDMENT BY
MAYOR.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the revised Second Amendment to Development Agreement dated
November 5, 2012, to include additional wording to define that
the City is acquiring the Crystal Distribution property "as is"
and limiting the liability for Crystal Distribution for the
conveyance for potential unknown environmental concerns for the
property going forward in redevelopment phases, with Crystal
Distribution being unaware of any potential concerns on the
property currently as a part of the agreement, by and between
Crystal Distribution Services, Inc. of Waterloo, Iowa and the
City of Waterloo, Iowa, be and the same is hereby approved, and
the Mayor and City Clerk authorized to execute the same in behalf
of the City of Waterloo, Iowa.
