Please do a pre-auth for an expenditure to D.W. Zinser Co., Inc. in the amount of$139,800.
As an emergency demolition, this contract (first attachment) did not go to Council for approval, but I did
seek bids, and got 4 bids (bid tab attached as second attachment).
Sounds like Bridget wanted to pay at least the first$15,000 invoice that we have received from Nuisance
Abatement Bonds. Perhaps we can list both Nuisance Abatement Bonds AND Downtown TIF for fund
codes to pay from (will it let you list two?).
The good news (from a paying expenses standpoint) is the demolition is on hold, so for now all we will
have to pay is the $15,000, and we will have to wait to see what the Courts decide before we know if we
can proceed with the rest of the demolition work.

The building owner did call WPD on us, but we were able to get the job completed.

The City of Waterloo intends to award the emergency demolition contract today. The demolition
contractor plans to be on site tomorrow setting up and working out details, and plans to be knocking
down the building on Wednesday.

Just checking for a follow up, is it still anticipated that the gas riser will be shut off/disconnected
soon? Hopefully on or before Monday, July 7th
I still anticipate the City making a contract award ON Monday, so demo work could start as early as 7/8.

I will get locates called in again for that area today!The building owner did call the cops on the locator last week
when he was trying to locate the utilities in the alley, so I told them to disregard the locate at that time.
We will try to get the gas service retired before next Friday!

Molly and Shane,
The City of Waterloo did win in the court actions last Thursday. There is some additional legal
maneuvering/appeals, so I'm not positive on our timeline...but it is possible that I could be sending out requests
for bids on the emergency demolition today or tomorrow. There was SOME discussion about trying to have a
contractor in there, and have the building down (at least in a pile) before the 4th of July. That may not be very
realistic, so it could end up being early that next week.
But figured I better touch base on the topic of utility disconnects.
Shane, I think you said that power was already off to the building, but that you did have a live pole in close
proximity that you may need to look at doing something with.
Molly,you had a riser behind the building in the alley that you were going to want to kill. Regarding access through
the fence, it was decided that is fine for MidAmerican to proceed (cautiously, as that wall still has potential for
collapse), and there is a gate on the easterly(southeasterly)end of the alley that you can use for access.

I don't have an answer yet on access past the fence, but the Mayor is interested in any input you could provide
regarding the potential danger of falling brick hitting the gas riser for purposes of providing that information during
the injunction hearing tomorrow.
I have copied Marty Petersen,the City Attorney,who will be handling the hearing from the City's side, but also may
be able to comment on the access through the fence to the public alley issue.

All,
I got a call from Molly Brouwer with MidAmerican Energy. She works on the "gas"side, and was planning to move
forward with disconnect of gas service to the building at 325 W Park Avenue. She was going to have utility locates
completed, but they can not access the area because of the fencing. They would not need to go into the building,
or even onto the property...they would only need access to the public alley behind the building. They have a live
gas riser in that alley that serves the building in question. They are concerned that if falling bricks hit that riser, it
could cause a significant incident.
I discussed that the property owner is resisting our efforts to demolish the building, and that he has filed for an
injunction to prevent us from demolishing, and that a hearing on that injunction will happen tomorrow. She is
willing to wait until next week to complete the disconnect work, but would like to get the locate work done as soon
as possible, and is asking for permission to enter the fenced area to access the public alley area and complete the
locates.
How could she proceed?

Update on 325 W Park Ave.
Miller Fence is in the process of setting up the 60 ft. perimeter fence
o The attachment above is pretty close to how they have it installed
o This set up does utilize the Lindgren Glass building as part of the perimeter fence and completely
encloses the garage that is owned by the radio station
There is a section of fence near the radio station garage (highlighted in orange on the
attachment)that will be open and serve as a gate for entry
o This set up also leaves a portion of the intersection of W Park Ave and Washington St open
o The 60 ft fence does close down W Park Ave and Washington St as the fence was installed all the
way out to the curb
o The fence also closes down the alley, however it still leave parking for radio station employees
The building owner/Rich Penn will still need to apply for the permits that Engineering was referencing to
shut down the streets and put in place detour signs/routes for affected traffic

Council,
I want to provide a brief update on the status of the unsafe building located at 325 West Park Avenue.
The City issued a 72-hour notice to the property owner(which expired today), requiring demolition of the
structure or notification that the City would proceed with the demolition. In addition, we filed the
necessary 657A paperwork along with an injunction to authorize the City to move forward with
demolition.
In response, the property owner has filed an emergency injunction to halt our efforts. The earliest court
date available is scheduled for this Thursday at 2:00 p.m.
As a safety precaution, we have requested a 60-foot perimeter be established around the building. Penn
has contracted Miller Fencing and is scheduled to install the fencing on Monday. Once that perimeter is
in place, we will be able to remove temporary barriers, but the road will remain closed until further
notice. We have been in contact with the DNR and companies that would be turnkey to demolish this
structure but as of now this is in the courts. In addition, we will make adjustments to barricades but our
main concern is not convenience, It's Safety!!
The fire department has notified silos and smokestacks to let them know the immediate danger and we
will continue to monitor the situation closely and pursue all available avenues to ensure public safety.

Hi Council,
I want to provide you with an important update regarding the property located at 325 West Park
Avenue, owned by Mr. Rich Penn.
As previously communicated on Thursday, the building began to deteriorate and partially collapse. The
area was immediately roped off, tagged, and we engaged with Mr. Penn. The County was able to serve
him with official papers requiring that he provide a response plan within 24 hours. Mr. Penn maintains
the belief that the building can be restored; however, our assessment remains firm that the structure
poses a significant public safety hazard. We continue to monitor the situation closely, especially with
the risk that any inclement weather could further compromise the integrity of the structure.
Since that initial communication, the following developments have occurred:
1. Additional perimeter fencing has been installed by the owner to help secure the site at the
request of the city.
2. Traffic control measures are in place to prevent any through traffic around the building, ensuring
pedestrian and vehicular safety.
3. AECOM and their structural engineer(who flew in from Chicago)were on-site this past Friday to
assess the condition of the structure.
4. The structural engineer is expected to deliver an assessment report regarding the building's
integrity by June 11.
5. We have initiated preliminary conversations with demolition companies that are prepared to
provide emergency services once an abatement plan is confirmed.
6. The Iowa Department of Natural Resources (DNR) has been contacted for guidance on any
potential asbestos or hazardous materials that may be present in the structure.
7. Mr. Penn has since been served with a 72-hour notice to submit a formal abatement plan.
8. Marty has been in communication with Mr. Penn's legal counsel to discuss ongoing
expectations and the status of his compliance.
9. After the 72 hours,we will begin taking a look at traffic impacts and start charging accordingly for
blocking of the streets.
We are continuing to monitor the site, and I have asked WPD to assess whether they can assist with
oversight during this period or camera support to make sure the building remains empty.

This matter remains a high priority, and we will provide further updates as new information becomes
available. Our shared goal remains to protect the public and ensure the swift and responsible
resolution of this dangerous situation.

Hi Council,
Today the building located at 325 West Park Avenue owned by Rich Penn began falling apart.We have
the area roped off, tagged and have been in communication with MR. Penn. We had the county finally
find him to serve him papers stating that he has 24 hours to come up with a plan. The problem is that he
believes the building can be restored. We are not of that same belief. The building is an extreme hazard
and we hope any inclement weather doesn't pull the roof down which would crumble the entire
building. His building doesn't only have roofing issues there are multiple structural issues. I am going to
see if WPD has the ability to monitor this site. Mr. Penn stated there will be additional barricades around
the building to keep people out but that wont be until 8 am tomorrow morning. I just wanted you all to be
aware that this is a hazard and our position is that it needs to be immediately remediated by the owner
and torn down.

Molly and Shane,
The City of Waterloo did win in the court actions last Thursday. There is some additional legal
maneuvering/appeals, so I'm not positive on our timeline...but it is possible that I could be sending out requests
for bids on the emergency demolition today or tomorrow. There was SOME discussion about trying to have a
contractor in there, and have the building down (at least in a pile) before the 4th of July. That may not be very
realistic, so it could end up being early that next week.
But figured I better touch base on the topic of utility disconnects.
Shane, I think you said that power was already off to the building, but that you did have a live pole in close
proximity that you may need to look at doing something with.
Molly,you had a riser behind the building in the alley that you were going to want to kill. Regarding access through
the fence, it was decided that is fine for MidAmerican to proceed (cautiously, as that wall still has potential for
collapse), and there is a gate on the easterly(southeasterly) end of the alley that you can use for access.

regarding the potential danger of falling brick hitting the gas riser for purposes of providing that information during
the injunction hearing tomorrow.

All,
I got a call from Molly Brouwer with MidAmerican Energy. She works on the "gas" side, and was planning to move
forward with disconnect of gas service to the building at 325 W Park Avenue. She was going to have utility locates
completed, but they can not access the area because of the fencing. They would not need to go into the building,
or even onto the property...they would only need access to the public alley behind the building. They have a live
gas riser in that alley that serves the building in question. They are concerned that if falling bricks hit that riser, it
could cause a significant incident.
I discussed that the property owner is resisting our efforts to demolish the building, and that he has filed for an
injunction to prevent us from demolishing, and that a hearing on that injunction will happen tomorrow. She is
willing to wait until next week to complete the disconnect work, but would like to get the locate work done as soon
as possible, and is asking for permission to enter the fenced area to access the public alley area and complete the
locates.
How could she proceed?

Update on 325 W Park Ave.
Miller Fence is in the process of setting up the 60 ft. perimeter fence
o The attachment above is pretty close to how they have it installed
o This set up does utilize the Lindgren Glass building as part of the perimeter fence and completely
encloses the garage that is owned by the radio station
There is a section of fence near the radio station garage (highlighted in orange on the
attachment)that will be open and serve as a gate for entry
o This set up also leaves a portion of the intersection of W Park Ave and Washington St open
o The 60 ft fence does close down W Park Ave and Washington St as the fence was installed all the
way out to the curb
o The fence also closes down the alley, however it still leave parking for radio station employees
The building owner/Rich Penn will still need to apply for the permits that Engineering was referencing to
shut down the streets and put in place detour signs/routes for affected traffic

Council,
I want to provide a brief update on the status of the unsafe building located at 325 West Park Avenue.
The City issued a 72-hour notice to the property owner (which expired today), requiring demolition of the
structure or notification that the City would proceed with the demolition. In addition, we filed the
necessary 657A paperwork along with an injunction to authorize the City to move forward with
demolition.
In response, the property owner has filed an emergency injunction to halt our efforts. The earliest court
date available is scheduled for this Thursday at 2:00 p.m.
As a safety precaution, we have requested a 60-foot perimeter be established around the building. Penn
has contracted Miller Fencing and is scheduled to install the fencing on Monday. Once that perimeter is
in place, we will be able to remove temporary barriers, but the road will remain closed until further
notice. We have been in contact with the DNR and companies that would be turnkey to demolish this
structure but as of now this is in the courts. In addition, we will make adjustments to barricades but our
main concern is not convenience, It's Safety!!
The fire department has notified silos and smokestacks to let them know the immediate danger and we
will continue to monitor the situation closely and pursue all available avenues to ensure public safety.

Hi Council,
I want to provide you with an important update regarding the property located at 325 West Park
Avenue, owned by Mr. Rich Penn.
As previously communicated on Thursday, the building began to deteriorate and partially collapse. The
area was immediately roped off,tagged, and we engaged with Mr. Penn. The County was able to serve
him with official papers requiring that he provide a response plan within 24 hours. Mr. Penn maintains
the belief that the building can be restored; however, our assessment remains firm that the structure
poses a significant public safety hazard. We continue to monitor the situation closely, especially with
the risk that any inclement weather could further compromise the integrity of the structure.
Since that initial communication, the following developments have occurred:
1. Additional perimeter fencing has been installed by the owner to help secure the site at the
request of the city.
2. Traffic control measures are in place to prevent any through traffic around the building, ensuring
pedestrian and vehicular safety.
3. AECOM and their structural engineer (who flew in from Chicago)were on-site this past Friday to
assess the condition of the structure.
4. The structural engineer is expected to deliver an assessment report regarding the building's
integrity by June 11.
5. We have initiated preliminary conversations with demolition companies that are prepared to
provide emergency services once an abatement plan is confirmed.
6. The Iowa Department of Natural Resources (DNR) has been contacted for guidance on any
potential asbestos or hazardous materials that may be present in the structure.
7. Mr. Penn has since been served with a 72-hour notice to submit a formal abatement plan.
8. Marty has been in communication with Mr. Penn's legal counsel to discuss ongoing
expectations and the status of his compliance.
9. After the 72 hours,we will begin taking a took at traffic impacts and start charging accordingly for
blocking of the streets.
We are continuing to monitor the site, and I have asked WPD to assess whether they can assist with
oversight during this period or camera support to make sure the building remains empty.
This matter remains a high priority, and we will provide further updates as new information becomes
available. Our shared goal remains to protect the public and ensure the swift and responsible
resolution of this dangerous situation.

Hi Council,
Today the building located at 325 West Park Avenue owned by Rich Penn began falling apart. We have
the area roped off, tagged and have been in communication with MR. Penn. We had the county finally
find him to serve him papers stating that he has 24 hours to come up with a plan. The problem is that he
believes the building can be restored. We are not of that same belief. The building is an extreme hazard

and we hope any inclement weather doesn't pull the roof down which would crumble the entire
building. His building doesn't only have roofing issues there are multiple structural issues. I am going to
see if WPD has the ability to monitor this site. Mr. Penn stated there will be additional barricades around
the building to keep people out but that wont be until 8 am tomorrow morning. I just wanted you all to be
aware that this is a hazard and our position is that it needs to be immediately remediated by the owner
and torn down.

Any additional insight? Not sure how I should respond.
Not sure how realistic getting a ruling "soon" that would allow them to proceed early next week before
they have to pull the machine.
If they pull off site before demo, the question is when will we be able to get them back, and will that align
up with a schedule that works for us (assuming at some point we are allowed to proceed). If it does not,
we would likely have to terminate the contract with DW Zinser after an agreed amount to pay them for
their work/time so far.
If it does work to get them back, probably will just have to agree on a change order to pay an additional
mobilization fee" for them having to come back a second time. As a point of reference, for Saint Mary's,
under change order#3, we paid Zinser$15,000 to bring the "high reach machine" up to Waterloo. Which
is the machine that they have in place now and will have to take away for another commitment soon.

Please find attached the fully signed contract. As discussed, you will get me the performance bond and
proof of insurance tomorrow.
Per the contract requirements, demolition of the building should be started by Wednesday, July 9, 2025
and the building safely reduced to a debris pile by Thursday, July 10, 2025.

Congratulations, DW Zinser is the low bidder for the Emergency Demolition Services (RACM) Contract
RD-2025-06-01 P.
Please find attached the contract. If all looks good, please print, sign, scan and send me a copy of it. I
will also need the performance bond, but you indicated it may take until tomorrow to get that, which is
fine. If I can get the contract back yet today, I would proceed with issuance of a Notice to Proceed.
Also,just a note, as discussed in the bid specs, the property to the southeast of the property in question
is a privately owned property that has a parking lot and a detached garage on it. The building has
partially collapsed onto this property, but the Contractor is not to enter this property except to the
limited extent required to remove building materials that have fallen onto the property. However, if
Contractor works out an access agreement with the owner, it could make demolition activities
easier. The legal name of the property owner is "NRG MEDIA LLC". They operate radio stations out of
the adjacent building at 512 Jefferson St (it may also be addressed 514 Jefferson St).
And as discussed on the phone, the City is very concerned about getting this building down safely as
quickly as possible, so your commitment to be knocking it down by Wednesday, July 9th based on an
award and notice to proceed occurring today is extremely important to the City.

I wanted to get this into your hands. We are still awaiting the signed copy from NRG Media. NRG Media
are the ones that created the document so I don't believe it will be an issue in getting it signed by them.

Molly and Shane,
The City of Waterloo did win in the court actions last Thursday. There is some additional legal
maneuvering/appeals, so I'm not positive on our timeline...but it is possible that I could be sending out requests
for bids on the emergency demolition today or tomorrow. There was SOME discussion about trying to have a
contractor in there, and have the building down (at least in a pile) before the 4th of July. That may not be very
realistic, so it could end up being early that next week.
But figured I better touch base on the topic of utility disconnects.
Shane, I think you said that power was already off to the building, but that you did have a live pole in close
proximity that you may need to look at doing something with.
Molly,you had a riser behind the building in the alley that you were going to want to kill. Regarding access through
the fence, it was decided that is fine for MidAmerican to proceed (cautiously, as that wall still has potential for
collapse), and there is a gate on the easterly(southeasterly) end of the alley that you can use for access.

regarding the potential danger of falling brick hitting the gas riser for purposes of providing that information during

All,
I got a call from Molly Brouwer with MidAmerican Energy. She works on the "gas" side, and was planning to move
forward with disconnect of gas service to the building at 325 W Park Avenue. She was going to have utility locates
completed, but they can not access the area because of the fencing. They would not need to go into the building,
or even onto the property...they would only need access to the public alley behind the building. They have a live
gas riser in that alley that serves the building in question. They are concerned that if falling bricks hit that riser, it
could cause a significant incident.
I discussed that the property owner is resisting our efforts to demolish the building, and that he has filed for an
injunction to prevent us from demolishing, and that a hearing on that injunction will happen tomorrow. She is
willing to wait until next week to complete the disconnect work, but would like to get the locate work done as soon
as possible, and is asking for permission to enter the fenced area to access the public alley area and complete the
locates.
How could she proceed?

Update on 325 W Park Ave.
Miller Fence is in the process of setting up the 60 ft. perimeter fence
o The attachment above is pretty close to how they have it installed
o This set up does utilize the Lindgren Glass building as part of the perimeter fence and completely
encloses the garage that is owned by the radio station
There is a section of fence near the radio station garage (highlighted in orange on the
attachment)that will be open and serve as a gate for entry
o This set up also leaves a portion of the intersection of W Park Ave and Washington St open
o The 60 ft fence does close down W Park Ave and Washington St as the fence was installed all the
way out to the curb
o The fence also closes down the alley, however it still leave parking for radio station employees
The building owner/Rich Penn will still need to apply for the permits that Engineering was referencing to
shut down the streets and put in place detour signs/routes for affected traffic

Council,
I want to provide a brief update on the status of the unsafe building located at 325 West Park Avenue.
The City issued a 72-hour notice to the property owner(which expired today), requiring demolition of the
structure or notification that the City would proceed with the demolition. In addition, we filed the
necessary 657A paperwork along with an injunction to authorize the City to move forward with
demolition.
In response, the property owner has filed an emergency injunction to halt our efforts. The earliest court
date available is scheduled for this Thursday at 2:00 p.m.
As a safety precaution, we have requested a 60-foot perimeter be established around the building. Penn
has contracted Miller Fencing and is scheduled to install the fencing on Monday. Once that perimeter is
in place, we will be able to remove temporary barriers, but the road will remain closed until further
notice. We have been in contact with the DNR and companies that would be turnkey to demolish this
structure but as of now this is in the courts. In addition, we will make adjustments to barricades but our
main concern is not convenience, It's Safety!!
The fire department has notified silos and smokestacks to let them know the immediate danger and we
will continue to monitor the situation closely and pursue all available avenues to ensure public safety.

Hi Council,
I want to provide you with an important update regarding the property located at 325 West Park
Avenue, owned by Mr. Rich Penn.
As previously communicated on Thursday, the building began to deteriorate and partially collapse. The
area was immediately roped off, tagged, and we engaged with Mr. Penn.The County was able to serve
him with official papers requiring that he provide a response plan within 24 hours. Mr. Penn maintains
the belief that the building can be restored; however, our assessment remains firm that the structure
poses a significant public safety hazard. We continue to monitor the situation closely, especially with
the risk that any inclement weather could further compromise the integrity of the structure.
Since that initial communication, the following developments have occurred:
1. Additional perimeter fencing has been installed by the owner to help secure the site at the
request of the city.
2. Traffic control measures are in place to prevent any through traffic around the building, ensuring
pedestrian and vehicular safety.
3. AECOM and their structural engineer (who flew in from Chicago)were on-site this past Friday to
assess the condition of the structure.
4. The structural engineer is expected to deliver an assessment report regarding the building's
integrity by June 11.
5. We have initiated preliminary conversations with demolition companies that are prepared to
provide emergency services once an abatement plan is confirmed.
6. The Iowa Department of Natural Resources (DNR) has been contacted for guidance on any
potential asbestos or hazardous materials that may be present in the structure.
7. Mr. Penn has since been served with a 72-hour notice to submit a formal abatement plan.
8. Marty has been in communication with Mr. Penn's legal counsel to discuss ongoing
expectations and the status of his compliance.
9. After the 72 hours, we will begin taking a look at traffic impacts and start charging accordingly for
blocking of the streets.
We are continuing to monitor the site, and I have asked WPD to assess whether they can assist with
oversight during this period or camera support to make sure the building remains empty.
This matter remains a high priority, and we will provide further updates as new information becomes
available. Our shared goal remains to protect the public and ensure the swift and responsible
resolution of this dangerous situation.

Hi Council,
Today the building located at 325 West Park Avenue owned by Rich Penn began falling apart.We have
the area roped off, tagged and have been in communication with MR. Penn.We had the county finally
find him to serve him papers stating that he has 24 hours to come up with a plan.The problem is that he
believes the building can be restored. We are not of that same belief. The building is an extreme hazard
and we hope any inclement weather doesn't pull the roof down which would crumble the entire
building. His building doesn't only have roofing issues there are multiple structural issues. I am going to
see if WPD has the ability to monitor this site. Mr. Penn stated there will be additional barricades around
the building to keep people out but that wont be until 8 am tomorrow morning. I just wanted you all to be
aware that this is a hazard and our position is that it needs to be immediately remediated by the owner
and torn down.

aware that any had.
Let me know if you have any thoughts. Otherwise we would need to decide and make an award on
Monday, unless any legal action prevents us from proceeding with demo.

I assume we can do it that way...but I have two main concerns with sending out the RFB before the order. 1)what
happens if something happens and there never is an order? I guess the answer is I send something out retracting
the RFB and stating that we are no longer taking bids...but just a little odd. And then 2) in multiple locations in the
RFB it talks about it being an emergency demolition pursuant to the "demolition order". So I'll have to reword that
and say what...pursuant to an "anticipated demolition order"? I'm not sure it is a good idea to have the deadline
for submitting proposals be ahead of the issuance of that order. I'm not saying we can't...I just don't think it is a
great idea...that way we can terminate the bid if we don't get an order.
I'm guessing, based on comments from the owner and the owner's attorney,that there is at least a chance that a
court could delay us from issuing that order.
But however you guys think we should proceed...

This is a follow-up to my previous email. Rich Penn returned my call this afternoon while I was in a meeting with
Greg Ahlhelm. I informed him that the necessary documentation had been provided to his wife earlier this morning
in his absence, and I reiterated that a secondary perimeter fence is required to be installed by this Friday. If it is not
in place by then,the City will move forward with installing the fence.
During our conversation, Rich repeatedly referenced lawyers and court orders, and he did not acknowledge the
immediate public safety concerns. Based on his responses and indication that he is pursuing legal action rather
than addressing the safety hazards,the City should prepare to proceed with installation of the perimeter fence on
Friday.

Lt.VanDyke and I conducted a site visit today at 325 W Park Ave and met with Mrs. Penn, Rich's wife. She was
provided with a hard copy of all the documents referenced above. Lt.VanDyke also captured body cam footage of
the meeting for documentation purposes.
Mrs. Penn was advised that she and her husband should have received a 72-hour notice yesterday and that
additional safety measures are now required to secure the site. Specifically, a secondary fence must be installed
to establish a 60-foot collapse zone around the building, as indicated in Schroeder's overhead diagram. She was
also advised to coordinate with Engineering/Traffic to ensure proper street closures and traffic rerouting.
Additionally, Silos and Smokestacks has been notified that the 60-foot collapse zone extends into their building
footprint. I will be reaching out to David Deeds with JSA shortly to make them aware of this development.

In addition to the fencing they will need to make sure that all traffic control to close down the streets meets MUTCD
requirements. Most likely this means that they will need to hire a traffic control company to close down the roads. They
will also need to set up detour routes around the site for traffic.

Just a suggestion, but I would suggest that we ask(or order)that he fence it something to the effect of the
attached. For the most part,this goes a little past your yellow lines. But it does two things: 1) it uses existing
buildings were possible,which reduces the total amount of fencing that would be needed, and 2) it puts it along
the back of curb on the OTHER side of the two streets to FULLY block off all vehicular lanes. I get that what you
drew was attempting to just off-set it 60', but if it cuts through part of a lane of traffic, people will still go around
barricades and squeeze along the fence.

Thank you for the update, Noel.
If Rich Penn is requesting documentation outlining the Fire Marshal's or Fire Code Official's authority to
deem a structure unsafe, I've attached Section 114 of the 2021 International Fire Code (IFC). This section
aligns closely with Section 116 of the 2021 International Building Code (IBC) and Sections 112 and 113 of
the 2021 International Property Maintenance Code (IPMC), which are also included for reference.
In this case, the Building Department, in coordination with the Fire Department, has placarded Rich's
building as unsafe. Regardless of the route taken, the determination remains that the structure is
currently unsafe.
In my conversations with Rich, he's provided a detailed history of the building and the work he claims to
have completed. However, at this point, the City requires structural engineering reports to determine
whether the building is salvageable or beyond repair.We also need a clear and definitive timeline for
either making the structure safe for repair or proceeding with demolition if it's deemed irreparable.
The next critical issue is the collapse zone, which currently extends into both W. Park Avenue,
Washington Street, and the public alley. Under the provisions in the attached codes, it is the
responsibility of the building owner to ensure public safety. Simply fencing off the property and placing
barricades at intersections is insufficient, as it does not fully mitigate the risk of secondary collapse. In
my opinion, Rich Penn should be required to install secondary fencing to completely isolate the collapse

zone from both pedestrian and vehicle traffic, including the public alley behind the building. Additionally,
the City should consider charging Mr. Penn the standard rate for any public street closures, consistent
with what other contractors would be required to pay.
I do not take the demolition of historic buildings—or any building—lightly. However, due to the
magnitude of the situation, the likelihood of secondary collapses, and the ongoing threat this structure
poses to the downtown community, my opinion remains that this building should be slated for
demolition.
As for the timeline moving forward, I believe this is a decision that will require collaboration and
consensus among all parties involved. My personal view differs significantly from Rich Penn's. While it is
clear he remains intent on saving the building, the opportunity to do so safely may have already passed.

Thanks again for your time yesterday. I enjoyed our conversation and I think we have a great
opportunity to turn the downtown Waterloo facade into a striking entry point to the heart of our
community. We must talk more about that.
I've attached below the images I took of the Candy Co building basement. I think they're the same
ones I sent Michelle. If you need others, just let me know.
Now here's the undated info on today's and next steps,
1. Fencing was completed around the site this AM.
2. Insurance Adjuster spent several hour there and will have their leading Structural Engr here
Monday. Our local insurance rep was here this afternoon and took additional pics.
3. I met with Dan Keagle from Peters Construction& he sent out Ray Starbuck. I asked him to outline
a plan based on the SE conclusions from the Ins Co. Peters can also put up reinforcements to
stabilize the side & rear wall.
4. I then had Jake Lehman from Lehman Excavating take a look at rubble removal. He can start as
soon as structural reinforcements are in place and he knows what the SE says has to be avoided &
saved.
5. Once the rubble is removed....rebuild can start.
6. The city Structural Engineer was in the building for about an hour. He took a lot of pics. He left just
before 5:00.
That's all I have today and I probably won't know much more until after Westfield's Structural Engr is
here Monday.
One final request. Please ask your people if they need something to give me a heads up before they
want to come by. I'm still trying to run a business.

As a side note, this is what the Fire Marshall said to KWWL news. "The building owner has been
advised to seek a structural engineer and architect if they're looking to save the building,"said
Weliver. "Otherwise, the City of Waterloo's stance is that the building is being deemed unsafe, and
our recommendation would be to bring the whole entire building to the ground."
As points of fact: I was looking for an Engineer long before the Fire Marshall showed up and we've
had architects involved for years. I really have problems with people that don't have all the facts. My
advice to the Fire Marshall....he might want to review some of the issues with the City of Waterloo
and that building before he threatens to have it torn down. I'm also unsure where the Fire Marshal
cites legal authority to deem a building unsafe, when it's not a fire hazard. I may be wrong. But if it's
not a fire hazard 1 don't believe he has the authority to designate a building for demolition with out an
Engineers report. If that is the case I would appreciate someone pointing me to that statute. I need to
see that because I always like to maintain a paper trail of the facts. I would be very happy to meet
with our Mayor and walk him through some of the other details on the recent history of that building.

I assume we can do it that way...but I have two main concerns with sending out the RFB before the order. 1)what
happens if something happens and there never is an order? I guess the answer is I send something out retracting
the RFB and stating that we are no longer taking bids...but just a little odd. And then 2) in multiple locations in the
RFB it talks about it being an emergency demolition pursuant to the "demolition order". So I'll have to reword that
and say what...pursuant to an "anticipated demolition order"? I'm not sure it is a good idea to have the deadline
for submitting proposals be ahead of the issuance of that order. I'm not saying we can't...I just don't think it is a
great idea...that way we can terminate the bid if we don't get an order.
I'm guessing, based on comments from the owner and the owner's attorney,that there is at least a chance that a
court could delay us from issuing that order.
But however you guys think we should proceed...

This is a follow-up to my previous email. Rich Penn returned my call this afternoon while I was in a meeting with
Greg Ahlhelm. I informed him that the necessary documentation had been provided to his wife earlier this morning
in his absence, and I reiterated that a secondary perimeter fence is required to be installed by this Friday. If it is not
in place by then,the City will move forward with installing the fence.

immediate public safety concerns. Based on his responses and indication that he is pursuing legal action rather

Everyone,
Lt.VanDyke and I conducted a site visit today at 325 W Park Ave and met with Mrs. Penn, Rich's wife.She was
provided with a hard copy of all the documents referenced above. Lt.VanDyke also captured body cam footage of
the meeting for documentation purposes.
Mrs. Penn was advised that she and her husband should have received a 72-hour notice yesterday and that
additional safety measures are now required to secure the site. Specifically, a secondary fence must be installed
to establish a 60-foot collapse zone around the building, as indicated in Schroeder's overhead diagram. She was
also advised to coordinate with Engineering/Traffic to ensure proper street closures and traffic rerouting.
Additionally, Silos and Smokestacks has been notified that the 60-foot collapse zone extends into their building
footprint. I will be reaching out to David Deeds with JSA shortly to make them aware of this development.

In addition to the fencing they will need to make sure that all traffic control to close down the streets meets MUTCD
requirements. Most likely this means that they will need to hire a traffic control company to close down the roads. They

Just a suggestion, but I would suggest that we ask(or order)that he fence it something to the effect of the
attached. For the most part,this goes a little past your yellow lines. But it does two things: 1) it uses existing
building s were possible,which reduces the total amount of fencing that would be needed, and 2) it puts it along
the back of curb on the OTHER side of the two streets to FULLY block off all vehicular lanes. I get that what you
drew was attempting to just off-set it 60', but if it cuts through part of a lane of traffic, people will still go around
barricades and squeeze along the fence.

If Rich Penn is requesting documentation outlining the Fire Marshal's or Fire Code Official's authority to
deem a structure unsafe, I've attached Section 114 of the 2021 International Fire Code (IFC).This section
aligns closely with Section 116 of the 2021 International Building Code (IBC) and Sections 112 and 113 of
the 2021 International Property Maintenance Code (IPMC), which are also included for reference.
In this case, the Building Department, in coordination with the Fire Department, has placarded Rich's
building as unsafe. Regardless of the route taken, the determination remains that the structure is
currently unsafe.
In my conversations with Rich, he's provided a detailed history of the building and the work he claims to
have completed. However, at this point, the City requires structural engineering reports to determine
whether the building is salvageable or beyond repair.We also need a clear and definitive timeline for
either making the structure safe for repair or proceeding with demolition if it's deemed irreparable.
The next critical issue is the collapse zone, which currently extends into both W. Park Avenue,
Washington Street, and the public alley. Under the provisions in the attached codes, it is the
responsibility of the building owner to ensure public safety. Simply fencing off the property and placing
barricades at intersections is insufficient, as it does not fully mitigate the risk of secondary collapse. In
my opinion, Rich Penn should be required to install secondary fencing to completely isolate the collapse
zone from both pedestrian and vehicle traffic, including the public alley behind the building. Additionally,
the City should consider charging Mr. Penn the standard rate for any public street closures, consistent
with what other contractors would be required to pay.
I do not take the demolition of historic buildings—or any building—lightly. However, due to the
magnitude of the situation, the likelihood of secondary collapses, and the ongoing threat this structure
poses to the downtown community, my opinion remains that this building should be slated for
demolition.
As for the timeline moving forward, I believe this is a decision that will require collaboration and
consensus among all parties involved. My personal view differs significantly from Rich Penn's.While it is
clear he remains intent on saving the building, the opportunity to do so safely may have already passed.

Thanks again for your time yesterday. I enjoyed our conversation and I think we have a great
opportunity to turn the downtown Waterloo facade into a striking entry point to the heart of our
community. We must talk more about that.
I've attached below the images I took of the Candy Co building basement. I think they're the same
ones I sent Michelle. If you need others, just let me know.
Now here's the undated info on today's and next steps,
1. Fencing was completed around the site this AM.
2. Insurance Adjuster spent several hour there and will have their leading Structural Engr here
Monday. Our local insurance rep was here this afternoon and took additional pics.
3. I met with Dan Keagle from Peters Construction& he sent out Ray Starbuck. I asked him to outline
a plan based on the SE conclusions from the Ins Co. Peters can also put up reinforcements to
stabilize the side & rear wall.
4. I then had Jake Lehman from Lehman Excavating take a look at rubble removal. He can start as
soon as structural reinforcements are in place and he knows what the SE says has to be avoided &
saved.
5. Once the rubble is removed....rebuild can start.
6. The city Structural Engineer was in the building for about an hour. He took a lot of pics. He left just
before 5:00.
That's all I have today and I probably won't know much more until after Westfield's Structural Engr is
here Monday.
One final request. Please ask your people if they need something to give me a heads up before they
want to come by. I'm still trying to run a business.

As a side note, this is what the Fire Marshall said to KWWL news. "The building owner has been
advised to seek a structural engineer and architect if they're looking to save the building,"said
Weliver. "Otherwise, the City of Waterloo's stance is that the building is being deemed unsafe, and
our recommendation would be to bring the whole entire building to the ground."
As points of fact: I was looking for an Engineer long before the Fire Marshall showed up and we've
had architects involved for years. I really have problems with people that don't have all the facts. My
advice to the Fire Marshall....he might want to review some of the issues with the City of Waterloo
and that building before he threatens to have it torn down. I'm also unsure where the Fire Marshal
cites legal authority to deem a building unsafe, when it's not a fire hazard. I may be wrong. But if it's
not a fire hazard I don't believe he has the authority to designate a building for demolition with out an
Engineers report. If that is the case I would appreciate someone pointing me to that statute. I need to
see that because I always like to maintain a paper trail of the facts. I would be very happy to meet
with our Mayor and walk him through some of the other details on the recent history of that building.

Either Noel or Lexi may be able to answer better on the housing incentives. I believe they try and
maintain a spreadsheet on that. Sometimes they are speculating(educated guess) how many units of a
multi-unit agreement will be done in a given year.
As for demo, I have recently given Ally the ok to pay for several demo costs, some of which went to
Nuisance. What date would your balance be thru for when subsequent expenses may not be showing
yet? As for future, I have about$300,000 worth of demolitions that I have "started" (by started, I have
done asbestos testing and in the process of abatement, or already have under demo contract). Now,
some of those properties are located within a TIF, so have SOME potential that they could be paid for by a
TIF instead of Nuisance. And then there are several other big ones on the horizon that will need to be
demolished (100 E 9th St, 310 Upland, 70 Sycamore St, 90 Sycamore St, 54 Lang St). Every single one of
those is in a TIF, but if the TIF's don't have enough cash/bonds on hand, I would have to use
Nuisance. Those 5 properties are probably in the $400,000 range to demolish, and $300,000 to abate
asbestos. So all in, I have about$1,000,000 in demolition activity. A very large part of that COULD be
paid by TIF as a vast majority of the properties are in one of the various TIF districts...but then it depends
on how much those TIF's can absorb.

I suppose we could proceed to pay the initial$15,000 from nuisance, but if the demo is ever allowed to
proceed (currently on hold based on court action), then we would need to have further evaluation of if the
nuisance bonds can afford that much based on all of the other commitments that are already planned
for those funds.

Please see attached Demolition Permit application from DW Zinser Company, Inc, on behalf of the City
of Waterloo under Emergency Demolition Services RACM Demo Contract RD-2025006-01 P, the
emergency demolition of 325 W Park Avenue. The building has been deemed unsafe and at risk of
collapse. The building has not and can not be tested and abated for asbestos, and will be demolished as
a Regulated Asbestos Containing Material (RACM) demo.
I have signed (or noted as N/A) all sign offs on the back of the sheet. I have confirmation from
MidAmerican Energy that electric and gas are disconnected. Per the contract specifications, sewer and
water kills can be completed AFTER the building is safely reduced to a pile of debris.
I have also attached the Demolition Order, as well as a map of the water service.
Dave and Zinser folks, even though per the specs the water can be completed AFTER demolition, Water
Works is wondering if you could complete the water kill at the water main tomorrow, ahead of demolition
which is on the opposite side of Park Avenue as the building, so a reasonably safe distance). If not, then
after the building is down, that should be the first priority, to avoid (or limit) the potential for a major leak
by demolishing a building with an active water service. As far as Water Works can tell, there is still active
water service to the building. They do not feel safe sending their guys to shut the service off at the pave
box, which is located close to the building along W Park Avenue (see attached water serve map).
I have talked with Jamie Knutson in Engineering, and the sewer service goes out the back of the building
into the alley. After demolition, Zinser can trace the service out the back and plug it at the property line
along the alley. If we have any map of this, I'll send it as well.
Jennifer, please issue the demolition permit and waive the fee, as it is a City Contract. Let me know if you
need anything else to issue the permit.

required to remove building materials that have fallen onto the property. However, if Contractor works
out an access agreement with the owner, it could make demolition activities easier. The legal name of
the property owner is "NRG MEDIA LLC". They operate radio stations out of the adjacent building at 512
Jefferson St (it may also be addressed 514 Jefferson St).
And as discussed on the phone, the City is very concerned about getting this building down safely as
quickly as possible, so your commitment to be knocking it down by Wednesday, July 9th based on an
award and notice to proceed occurring today is extremely important to the City.

Congratulations, DW Zinser is the low bidder for the Emergency Demolition Services (RACM) Contract
RD-2025-06-01 P.
Please find attached the contract. If all looks good, please print, sign, scan and send me a copy of it. I
will also need the performance bond, but you indicated it may take until tomorrow to get that,which is
fine. If I can get the contract back yet today, I would proceed with issuance of a Notice to Proceed.
Also,just a note, as discussed in the bid specs, the property to the southeast of the property in question
is a privately owned property that has a parking lot and a detached garage on it. The building has partially
collapsed onto this property, but the Contractor is not to enter this property except to the limited extent
required to remove building materials that have fallen onto the property. However, if Contractor works
out an access agreement with the owner, it could make demolition activities easier. The legal name of
the property owner is "NRG MEDIA LLC". They operate radio stations out of the adjacent building at 512
Jefferson St (it may also be addressed 514 Jefferson St).
And as discussed on the phone, the City is very concerned about getting this building down safely as
quickly as possible, so your commitment to be knocking it down by Wednesday, July 9th based on an
award and notice to proceed occurring today is extremely important to the City.
