Subject to (a) easements, conditions, and restrictions of record; (b) general utility and right- of-way easements serving the property and of record, and (c) restrictions imposed by local zoning ordinances and other applicable law. Further subject to possibility of reverter of title pursuant to a Development Agreement executed by and between the parties and dated April 15, 2024, amended May 22, 2024, and amended December 2, 2024. This is a deed from a political subdivision that is exempt from transfer tax, declaration of value, and groundwater hazard statement pursuant to Iowa Code § 428A.1(2) and Iowa Code § 428A.2(6). The grantor hereby covenants with grantees, and successors in interest, to warrant and defend the real estate against the lawful claims of all persons claiming by, through, or under it, except as may be stated above. Words and phrases herein, including acknowledgment hereof, shall be construed as in the singular or plural number, and as masculine or feminine gender, according to the context.
