RESOLUTION NO. 2012-1002 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE PROPOSED DEVELOPMENT AGREEMENT WITH STICK BROTHERS, L.L.C. TO SELL AND CONVEY FOR $1.00, PLUS COSTS, APPROXIMATELY 13 ACRES OF CITY -OWNED PROPERTY GENERALLY LOCATED ALONG THE WEST SIDE OF NORTHEAST DRIVE, SOUTH OF MARTIN LUTHER KING, JR. DRIVE AND JUST SOUTH OF THE RAILROAD TRACKS, FOR THE PURPOSE OF A RUBBLE DEPOSIT AND ROCK CRUSHING OPERATIONS, AS OCTOBER 22, 2012, AT 5:30 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: Section 1. That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 5:30 p.m. on the 22nd day of October, 2012, for the purpose of considering and acting upon a proposed Development Agreement with Stick Brothers, L.L.C. to sell and convey for $1.00, plus costs, approximately 13 acres of city - owned property generally located along the west side of Northeast Drive, south of Martin Luther King, Jr. Drive and just south of the railroad tracks, for the purpose of a rubble deposit and rock crushing operations, and legally described as follows: A parcel of land located in the Southeast 1/4 of the Southwest 1/4, the Northeast 1/4 of the Southwest 1/4, and the Northwest 1/4 of the Southeast 1/4, all in Section 20, Township 89 North, Range 12 West of the Fifth Principal Meridian, Waterloo, Black Hawk County, Iowa, more particularly described as follows: Commencing at the Southwest corner of the Southeast 1/4 of said Section 20; thence South 89032'32" West on the South line of the Southwest 1/4 of said Section 20 a distance of 663.43 feet to the Southwest corner of the East 1/2 of the Southeast 1/4 of the Southwest 1/4 of said Section 20; thence North 01000'42" West on the West line of the East 1/2 of the Southeast 1/4 of the Southwest 1/4 of said Section 20 a distance of 1,289.91 feet to the point of beginning of the parcel herein described; thence continuing North 01000'42" West on the West line of the East 1/2 of the Southeast 1/4 of the Southwest 1/4 of said Section 20 a distance of 37.97 feet to the Northwest corner of the East 112 of the Southeast 1/4 of the Southwest 1/4 of said Section 20; thence North 01004'28" West on the West line of the East 1/2 of the Northeast 1/4 of the Southwest 1/4 of said Section 20 a distance of 646.85 feet to the Southeasterly right-of-way line of the Union Pacific Railroad; thence North 78058'06" East on the Southeasterly right-of-way line of the Union Pacific Railroad a distance of 93.70 feet to the North line of the South 1/2 of the Northeast 1/4 of the Southwest 1/4 of said Section 20; thence North 89034140" East on the Resolution 2012-1002 Page 2 North line of the South 1/2 of the Northeast 1/4 of the Southwest 1/4 of said Section 20 a distance of 568.51 feet to the Northeast corner of the South 1/2 of the Northeast 1/4 of the Southwest 1/4 of said Section 20; thence North 89°26'35" East on the North line of the South 1/2 of the Northwest 1/4 of the Southeast 1/4 of said Section 20 a distance of 396.44 feet; thence Southwesterly on a 502.96 -foot radius curve concave Northwesterly and having a 469.69 -foot long chord bearing South 37053103" West a distance of 488.69 feet (arc length); thence South 65046'38" West a distance of 828.62 feet to the point of beginning. Containing 11.01 acres. Basis of bearings: The South line of the Southwest 1/4 of said Section 20 is assumed to bear South 89032132" West for the purpose of this description. And, A parcel of land located in the Northeast Quarter of the Southwest Quarter (NE SW), and the Northwest Quarter of the Southeast Quarter (NW SE), all in Section 20, Township 89 North, Range 12 West, Black Hawk County, Iowa, described as: That part of the North One-half of the Northeast Quarter of the Southwest Quarter, and that part of the North One-half of the Northwest Quarter of the Southeast Quarter, all lying Westerly of a line parallel with and 75 feet West of the centerline of Northeast Drive, and lying Southerly of the Union Pacific Railroad right-of-way.
