RESOLUTION NO. 2012-1028 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE PROPOSED EXCHANGE AGREEMENT AND ASSIGNMENT OF OFFER TO BUY REAL ESTATE AND ACCEPTANCE WITH L AND H FARMS, LTD. FOR THE ACQUISITION OF PROPERTY IN BLACK HAWK COUNTY FOR EXCHANGE OF PROPERTY IN THE SAN MARNAN TIF DISTRICT IN THE AMOUNT OF $333,000.00 FOR 8.375 ACRES OF LAND ACQUIRED AND AN OPTION EXCHANGE AGREEMENT, AS NOVEMBER 5, 2012, AT 5:30 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: Section 1. That the Council of the City of Waterloo, Iowa shall meet at City Hall Council Chambers in the City of Waterloo, Iowa at 5:30 p.m. on the 5th day of November, 2012, for the purpose of considering and acting upon a proposed Exchange Agreement and Assignment of Offer to Buy Real Estate and Acceptance with L and H Farms, Ltd. for the acquisition of property in Black Hawk County for exchange of property in the San Marnan TIF District in the amount of $333,000.00 for 8.375 acres of land acquired and an Option Exchange Agreement, and legally described as follows: Farm Land The North Half of the Northwest Quarter of Section 26, Township 88 North, Range 13 West of the 5th P.M., Black Hawk County, Iowa, except the North 55 feet thereof, and except the East 1,722 feet thereof, and except the South 470 feet of the North 525 feet of the West 230 feet thereof, and except the South 310 feet of the North 835 feet of the West 330 feet thereof (22.2 acres more or less). Subject to easements, restrictions, covenants, ordinances and limited access provisions of record and not of record. Development Land The South 142.5 feet of the North 185.5 feet of the North Half of the Southwest Quarter (N ',� SW 1-14) in Section No. 9, Township No. 88 North, Range No. 13 West of the Fifth Principal Meridian, Black Hawk County, Iowa, EXCEPT that part thereof conveyed to the City of Waterloo in a deed filed March 14, 2012 as Doc. No. 2012-16922 in the Office of the Black Hawk County Recorder. Subject to easements, restrictions, covenants, ordinances and limited access provisions of record and not of record.
