RESOLUTION NO. 2012-1038 RESOLUTION APPROVING THE REQUEST OF STICK BROTHERS, L.L.C. FOR A SITE PLAN AMENDMENT TO THE "M -2,P" PLANNED HEAVY INDUSTRIAL DISTRICT TO ALLOW FOR THE ESTABLISHMENT OF A ROCK CRUSHING OPERATION AND RUBBLE FILL SITE GENERALLY LOCATED ALONG THE WEST SIDE OF NORTHEAST DRIVE, SOUTH OF MARTIN LUTHER KING, JR. DRIVE AND JUST SOUTH OF THE RAILROAD TRACKS IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. WHEREAS, it has been proposed that the Council of the City of Waterloo, Iowa, approve a site plan amendment to the "M -2,P" Planned Heavy Industrial District to allow for the establishment of a rock crushing operation and rubble fill site generally located along the west side of Northeast Drive, south of Martin Luther King, Jr. Drive and just south of the railroad tracks, legally described as follows: A parcel of land located in the Southeast 1/4 of the Southwest 1/4, the Northeast 1/4 of the Southwest 1/4, and the Northwest 1/4 of the Southeast 1/4, all in Section 20, Township 89 North, Range 12 West of the Fifth Principal Meridian, Waterloo, Black Hawk County, Iowa, more particularly described as follows: Commencing at the Southwest corner of the Southeast 1/4 of said Section 20; thence South 89032132" West on the South line of the Southwest 1/4 of said Section 20 a distance of 663.43 feet to the Southwest corner of the East 1/2 of the Southeast 1/4 of the Southwest 1/4 of said Section 20; thence North 01000142" West on the West line of the East 1/2 of the Southeast 1/4 of the Southwest 1/4 of said Section 20 a distance of 1,289.91 feet to the point of beginning of the parcel herein described; thence continuing North 01°00'42" West on the West line of the East 1/2 of the Southeast 1/4 of the Southwest 1/4 of said Section 20 a distance of 37.97 feet to the Northwest corner of the East 1/2 of the Southeast 1/4 of the Southwest 1/4 of said Section 20; thence North 01°04'28" West on the West line of the East 1/2 of the Northeast 1/4 of the Southwest 1/4 of said Section 20 a distance of 646.85 feet to the Southeasterly right-of-way line of the Union Pacific Railroad; thence North 78058106" East on the Southeasterly right-of-way line of the Union Pacific Railroad a distance of 93.70 feet to the North line of the South 1/2 of the Northeast 1/4 of the Southwest 1/4 of said Section 20; thence North 89°34'40" East on the North line of the South 1/2 of the Northeast 1/4 of the Southwest 1/4 of said Section 20 a distance of 568.51 feet to the Northeast corner of the South 1/2 of the Northeast 1/4 of the Southwest 1/4 of said Section 20; thence North 89°26'35" East on the North line of the South 1/2 of the Northwest 1/4 of the Southeast 1/4 of said Section 20 a distance of 396.44 feet; thence Southwesterly on a 502.96 -foot radius curve concave Northwesterly and having a 469.69 -foot long chord bearing South 37°53'03" West a distance of 488.69 feet (arc length) ; thence South 65046138" West a distance of 828.62 feet to the point of beginning. Basis of bearings: The South line of the Southwest 1/4 of said Section 20 is assumed to bear South 89°32'32" West for the purpose of this description. And, A parcel of land located in the Northeast Quarter of the Southwest Quarter (NE SW), and the Northwest Quarter of the Southeast Quarter (NW SE), all in Section 20, Township 89 North, Range 12 West, Black Hawk County, Iowa, described as: That part of the North One-half of the Northeast Quarter of the Southwest Quarter, and that part of the North One-half of the Northwest Quarter of the Southeast Quarter, all lying Westerly of a line parallel with and 75 feet West of the centerline of Northeast Drive, and lying Southerly of the Union Pacific Railroad right-of-way. WHEREAS, a public hearing was held on October 22, 2012, at 5:30 p.m., at City Hall Council Chambers, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to approve said above mentioned site plan amendment, and WHEREAS, it is the opinion of this Council that said site plan amendment should be approved as proposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that a site plan amendment to the "M-2,2" Planned Heavy Industrial District to allow for the establishment of a rock crushing operation and rubble fill site generally located along the west side of Northeast Drive, south of Martin Luther King, Jr. Drive and just south of the railroad tracks, be and the same is hereby approved.
