RESOLUTION NO. 2025-560 RESOLUTION APPROVING A PERMANENT EASEMENT AGREEMENT IN THE AMOUNT OF $4,858.00, AND REIMBURSEMENT FOR PAVEMENT REMOVAL IN THE AMOUNT OF $983.00, TOTALING A JUST COMPENSATION AMOUNT OF $5,841.00, WITH BEVERLY REALTY, LLC, LOCATED AT 1507 LA PORTE ROAD, IN CONJUNCTION WITH THE LA PORTE ROAD PHASE II RECONSTRUCTION PROJECT, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS the City of Waterloo is undertaking the La Porte Road Phase II Reconstruction Project to enhance infrastructure and transportation facilities; and WHEREAS, a Permanent Easement Agreement with Beverly Realty, LLC is required to facilitate the project's completion, with compensation based on fair market value considerations; and WHEREAS, the total just compensation for the easement and reimbursement for pavement removal is $5,841.00, reflecting $4,858.00 for the easement and $983.00 for pavement removal; and WHEREAS, execution of this agreement aligns with the project's goals and complies with legal requirements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that: 1. The Permanent Easement Agreement with Beverly Realty, LLC, including reimbursement for pavement removal, totaling $5,841.00, is hereby approved. 2. The easement agreement is necessary for the successful execution and completion of the La Porte Road Phase II Reconstruction Project, ensuring public benefit and infrastructure improvement. 3. The Mayor and City Clerk are authorized and directed to execute said documents on behalf of the City of Waterloo, Iowa.
