RESOLUTION NO. 2012-958
RESOLUTION GRANTING PERMISSION TO MAXINE
FARIS FOR A WAIVER FOR AN ASPHALT DRIVEWAY TO
BE LOCATED AT 4192 LOGAN AVENUE, AND
AUTHORIZING CONSTRUCTION OF AN ASPHALT
DRIVEWAY WITH ELIMINATION OF THE SIDEWALK
SECTION.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Maxine Faris be authorized and
permitted to construct an asphalt driveway with elimination of
the sidewalk section, to be located at 4192 Logan Avenue, and
legally described as follows:
Unplatted Waterloo East West 638.3 feet Southwest 1-4
Southwest 1-4 Section 36 Township 90 Range 13 except West
349 feet South 858 feet & except South 363 feet East
289.3 feet & except North 33 feet South 396 feet West
459 feet & except North 140 feet West 311.1 feet &
except Highway Section 36 Township 90 Range 13;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Maxine Faris to construct an asphalt driveway
with elimination of the sidewalk section, to be located at 4192
Logan Avenue, subject to the following conditions:
1. Work to be performed by an approved and bonded
contractor.
2. A permit is to be obtained from the office of the City
Engineer prior to construction.
3. All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
PASSED AND ADOPTED this 1st day of October, 2012.
